Ty sues Hard Rock Cafe-Ty Inc., the Westmont-based maker of Beanie Babies plush toys, sued Hard Rock Cafe International Inc. for allegedly selling toy bears that infringe on its copyrights. The suit filed in federal court in Chicago claims a Hard Rock-sold bear named Isaac Beara is virtually identical to Beanie Babies. Hard Rock is a unit of Rank Group PLC
 

Got your limited-edition Clubby Bear yet?-Last August, when a Consummate Consumer column recounted the frustrations of a Maryland mother waging a campaign to get the $25.99 Clubby Bear she had ordered six months earlier, the story spread rapidly among Beanie Baby collectors nationwide. Dozens of other angry Beaniacs sent their tales of waiting woes for the Beanie Baby Official Club (BBOC) bears.

Instead of the plushy, royal-blue bears, all they got, they said, was the run-around from unresponsive customer service reps at Cyrk Inc.--the Gloucester, Mass., company that markets BBOC-related products.

According to the Federal Trade Commission (FTC), the company proved far more efficient at cashing the customers' checks than at delivering the goods. The FTC recently charged Cyrk with violating the FTC Mail Order Rule that requires merchants to ship ordered merchandise within the time promised in their solicitations. In some cases, Cyrk missed its promised delivery date (within four to six weeks after Clubby's "birthdate" of July 1998) by more than a year.
 
 

Three men were charged Thursday with orchestrating a $20,000 Internet scam- in which customers did not receive the Beanie Babies they purchased online, prosecutors said.
The Philadelphia men placed ads on America Online falsely advertising the sale of "retired" or discontinued Beanie Babies, according to the U.S. Attorney's Office. At least 12 people answered the ads, some requesting dozens of the stuffed animals for between $10 and $70 each.

Samuel Miletto, 30, who prosecutors said masterminded the plan, was indicted on 19 counts of wire fraud. He faces up to 105 years in prison. Joseph Reed, 31, and Louis Lloyd, 34, were each charged with one count of wire fraud. They both face up to five years in prison.

Regrets-I regret that I have not be able to update my news page as often as before..and I hope that you will be patience with me and understand.  My pet , Taz, a boston terrier has been very ill.  He suffers from seizures and recently had a very bad episode that has left him with brain damage.  I had hoped that the damage was not permanant but now it appears that it is and that Taz will have to be put to sleep.  I love him very much and have put this off because the doctor says he does not appear to be in any pain but I can imagine the frustration he faces each day bumping into anything in his path because the brain damage has left him blind.  He no longer barks or plays... only exists.  He is like a baby now and must be watched while eating because he stumbles and spills his food which is only soft food now.  He must stay in a crate now when I can not be there to watch his every move so that he does not bump into the furniture and hurt himself..Please pray for him that he will be healthy again.
