The Constitution of the Freehold of Prifarrd
Preamble
We the People of the Freehold of Prifarrd, in assembly gathered, and with the blessings of the King, do ordain and establish this Constitution for the governing of us and our heirs.


Article I
The government shall be divided into three branches, the executive, legislative, and judicial.

Article II
The Executive
The Executive branch shall consist of a King, and ministers as deemed necessary by the King, with the approval of Parliament and consent of the People.

Article III
The Legislative
The legislative branch shall be called the Parliament, and divided into two (2) chambers. The House of Nobles, and the Assembly of Delegates. The House of Nobles shall consist of all nobles with the title of earl or above of the several duchies of the Freehold. The Assembly shall consist of assemblymen elected from the duchies, relative to each duchys population. No person, except the King, can hold a seat in both chambers. No noble with a title higher than baron may sit in the Assembly of Delegates, the King excepted.

Article IV
The Judicial
The Judicial branch shall consist of judges (an even number, as the King shall be a judge,also) appointed by the King and approved by a simple majority (50%+1) vote of both Chambers of Parliament. The name of the judicial shall be The Royal High Court. It will not be the responsibility of the Royal High Court to make laws, but to interpret the law.

Article V
Powers
All power is in the hands of the People, which is exercised through their duly elected representives in the Assembly of Delegates, the Nobles in the House of Nobles, and the King. All bills, laws, etc. shall be framed,"By the will of the King, the approval of Parliament, and the consent of the People.".

Article VI
Duties
Section 1. Duties of the Parliament
The legislative Powers herein granted shall be vested in the Parliament, which shall consist of two (2) chambers, The House of Nobles, and the Assembly of Delegates.

The Parliament shall have Power to lay and collect taxes, duties, to pay the debts, and provide for the common defense and general welfare of the People of the Freehold; but all taxes and duties shall be uniform throughout the Freehold and approved by the King.

The Parliament shall have the Power to regulate Commerce with foreign nations, to establish a uniform rule(s) for Naturalization, to coin money, regulate the value thereof, and of foreign coin, and shall fix the Standard of Weights and Measures.

The Parliament shall have the Power to establish a Post Office and Postal roads, and the printing and issuing of Postal stamps.

The Parliament shall have the Power to raise and support armies, navies, air forces, and militia, to call forth the militia to execute the laws of the Freehold, suppress insurrections, and repeal invasions.

The Parliament shall have the Power to provide for organizing, arming, and disciplining the militia, and governing such parts of them as may be employed to the service of the Freehold, reserving to the duchies respectively, the appointment of the officers, and the authority of training the militia according to the discipline prescribed by Parliament.

The Parliament shall have the Power to make all laws which shall be necessary and proper for carrying into execution the fore going Powers, and all other Powers vested by this Constitution in the goverment of the Freehold of Prifarrd, or in any officer or ministry thereof, with the will of the King and consent of the People of the Freehold.

No law, bill, edict, or other declaration made by Parliament, or any other officer of the Freehold will be enforced without the will of the King and the consent of the People.

No person holding any office of trust under them, shall, without the will of the King and approval of Parliament, accept any present, emolument, office, or title of any kind whatever, from any king, prince, or foreign state.

Section 2. Duties of the King.
The executive Power shall be vested in the King of the Freehold of Prifarrd, he shall hold the title for life with the approval of Parliament, and consent of the People.

The Parliament by majority vote may recommend the removal of the King to the People, but only a majority vote of the People can remove the King.

The King shall be the Commander in Chief of the Armed Forces of the Freehold and of the militia of the several duchies, when called into the actual service of the Freehold; he may require the Opinion, in writing of the principal Ministers in each of the executive ministries, upon any subject relating to their respective offices.

He shall have the Power, with the approval of Parliament, and consent of the People, to make treaties, providing two thirds (2/3) of the Parliament present approve, and a majority vote of the People concur; and he shall nominate, with the approval of both chambers of Parliment, and appoint Ambassadors, Ministers, Consuls, and Judges of the Royal High Court, otherwise provided for, and which shall be established by law.

The King shall have, with the approval of Parliament, the Power to fill any vacancies that may occur in any of the above offices.

The King shall from time to time give to Parliament and the People, information on the State of the Freehold, and recommend to their consideration such measures as he shall judge necessary and expedient; he shall receive Ambassadors and other public Ministers; he shall take care that the laws be faithfully executed; and shall commission, with the approval of Parliament, the Officers of the Freehold of Prifarrd.

The Crown Prince (or Princess Royal) shall be the president pro tem of the House of Lords, in the event there is neither, the First Minister will act in that capacity.

All civil officers of the Freehold shall be removed from office on impeachment for, and conviction of, treason, bribery, or other high crimes and misdemeanors.

Section 3, Duties of the Judicial.
The judicial Power of the Freehold of Prifarrd shall be invested in one (1) Royal High Court and in such inferior courts as the King and Parliament may from time to time ordain and establish. The judges of the Royal High and inferior courts shall hold their offices during good behavior, and at the will of the King and approval of Parliament.

The judicial Power shall extend to all cases, in law and equity, arrising under this Constitution, the Laws of the Freehold of Prifarrd, and treaties made, or which shall be made, under their authority, to all cases affecting Ambassadors, other public ministers and consuls; to all cases of admiralty and maritime jurisdiction; to controversies to which the Freehold of Prifarrd shall be a party; to controversies between two (2) or more duchies; between a citizen(s) and a duchy; between citizen(s) and a different duchy; between citizens of different duchies; between a duchy or a citizen thereof and a foreign State.

Trial of all crimes, except impeachment, shall be by jury; and such trial shall be held in the duchy where said crimes shall have been committed: but when not committed within any duchy, the trial shall be at such place or places as the Parliament may by law, direct.

Treason against the Freehold of Prifarrd shall consist only in levying war against it, or to adhering to its enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two (2) witnesses to the same overt act, or on open confession in open court.

Article VII

Conclusions

This Constitution, and the Laws of the Royal Freehold of Prifarrd which shall be made in pursuance thereof; and all treaties made, or which shall be made, under authority of the Freehold of Prifarrd and the will of the King, approval of Parliament and consent of the People, shall be the supreme law of the land, and all judges in every duchy shall be bound thereby, any thing in the Constitution or Laws of any duchy to the contrary notwithstanding.

The members of Parliament before mentioned, and all executive and judicial officers, both of the Freehold of Prifarrd and of the several duchies, shall be bound by oath or affirmation, to support the King and this Constitution; but no religious test shall ever be required as a qualification to any office or public trust under the Freehold of Prifarrd.

The citizens of each duchy shall be entitled to all the privileges and immunities of Citizens of the several duchies.

A person charged in any duchy with treason, felony, or other crime, who shall flee from justice, and be found in another duchy, shall on demand of the executive authority of the duchy from which (s)he fled, be delievered up, to be removed to the duchy having jurisdiction of the crime.

The Freehold of Prifarrd shall guarantee to every duchy a constitutional form of goverment, and shall protect each of them against invasion, and on application of the Duchy Council or Duke of the duchy (when the council cannot be convened) against domestic violence.

Article VIII

The Rights of the People


1. Parliament shall not establish a state religion, or prohibit the free exercise thereof; or suppress the freedom of speech, of the press, or the right of the People to assemble peacefully, and to petition the King and/or Parliament for a redress of grievance.

2. The King nor Parliament shall institute any law which infringes on the right of the People to keep and bear arms.

3. The goverment shall not quarter troops in private homes without the consent of the owner of same.

4. The People shall have the right to be secure in their homes, their person, papers, and effects, against unreasonable searches and seizures. No warrant shall be issued, but upon probable cause, support by oath or affirmation, and particularly describing the place(s) to be searched, and the person(s) or thing(s) to be seized.

5. No person shall have to witness against him/herself, nor twice put in jeopardy of life, limb, or property, for the same crime, nor deprived of life, liberty, or property, without due process of the Law; nor shall private property be taken for public use without just compensation.

6. In any trial, the accused shall have the right to a speedy and public trial, by his peers,an impartial jury of the duchy wherein the crime shall have been committed, and to be informed of the nature and cause of the accusations; to be confronted by his accusor(s), and the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have assistance of counsel for his defense.

7. In suits at common law, where the value in controversy shall exceed one hundred (100) ryals, the right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise re-examined in any court of the Freehold of Prifarrd, than according to the rules of common law.

8.Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusal punishment inflicted.

9. The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the King or Parliament.

10. The Powers not delegated to the Freehold of Prifarrd by the King or Parliament, are reserved to the King.

11. Neither slavery nor involuntary servitude, except as punishment for crime, whereof the party shall have been duly convicted, shall exist within the Freehold of Prifarrd.

12. The right of the People to vote shall not be denied or abridged by the Freehold of Prifarrd, or by any duchy thereof, on account of race, religion, sex, or sexual preference.
