Executrix - Wife Barbara Albaugh - Execution of Will, 11 Aug 1795

In the name of God Amen,I Philip Albaugh, of Frederick County and the State of Maryland, do make this my last Will and Testament in the manner following. It is my will and Desire that all my Just Debts and Funeral Charges be fully paid and Satisfied--- I give to my wife Barbara the bed where on we usually Slept for her own use forever. It is my will and desire that the Lands where on I now live called Crooked Stripe be sold by my executrix to the best Advantage and the Money Arising therefrom and the Money arising from my Personal Estate to be placed in the hands of my wife Barbara to be by her applied to the Support of herself and my Children in such manner as she may think best so as to expend any part of the Whole thereof in such Support if the same shall be ---the whole or any part of such money not expended as afore said to remain in her hands during her life and at her Decease to be equally divided among my five children Namely Barbara, Philip, Mary, John & Peter. Provided however if my said wife shall marry again she is to retain for her own use only one third part of Such Sum as shall remain on hands on the day of her marriage---the other two thirds to remain in her hands for the use of my said children providing she or her husband immediately after such marriage give Security for paying to my said children respectively as they come if age such dividend as they are entitled to: but should my wife or her future husband neglect or refuse to give Security my Children being of Proper Age Shall be at liberty to choose a Guardian or Guardians or if they are not of a proper age then Orphan Court will choose for them with Power to receive from my Wife Such Guardians and apply the same to their Support I bequeath to my Wife Barbara her own & my Saddle forever I constitute and appoint my Wife Barbara Sole Executrix of this my last Will and Testament with full power to sell my land and give Titles therefore as fully and as Amply as I myself can or might do hereby revoking all former Wills made by me and Declaiming this to be my last Will and Testament In Witness Whereof I have hereunto set my hand & Seal this twenty third day of July in the Year one thousand seven hundred and ninety five

Then came Barbara Albaugh and made oath on this holy Evangels of Almighty God that the afore going Instrument of Writing is the true and Whole Will and Testament of Philip Albaugh late of Frederick County Decreed that hath come to her hands and Possession and that she Doth not know of any other

Then came John Albaugh and William Albaugh two of the Subscribing Witnesses to the aforegoing last Will and Testament of Philip Albaugh late of Frederick County Decreed and made oath on the Holy evangels of Almighty God that they did see the testator above in named Sign and Seal this will that they heard him publish and Pronounce and Declare the same to be his last Will and Testament that at the time of his so doing to the best of their apprehensions of a sound and disposing mind memory and understanding that they respectively subscribed their names as Witnesses to this Will in the Presence and at the request of the Testator and that they did also see Robert Cumming the other Subscribing Witness of Sign his name as a Witness of thoust in the Presence and at the request of the Testator and in the Presence of each other
