Beaufort County Alert

Information:

Beaufort County School District is giving private homeschool information to the public at large.

Beaufort County has prepared a packet for anyone who comes to them that is interested in homeschooling. Included in this packet is:

a District Homeschool Application,
the complete Educational Code of Law for SC,
a GRACE Association Brochure,
a SCAIHS Association Brochure,
and a compiled list of support groups of Beaufort County, that lists names and phone numbers of homeschoolers (some of which have never been leaders or even joined these support groups).

Pat at the Beaufort district office claimed that last year she obtained verbal permission from these parents to do this. All NBHSA members listed, have informed Ann Ashley, the director of NBHSA, that they have neither given verbal or written permission at anytime, for their personal information to be given out in print and placed in this packet (nor have they in any other fashion).

Upon learning that NBHSA had a copy of the packet, Pat confirmed to Ann this afternoon, that she had obtained verbal permission over the phone from each party named to be listed last year, but not this year. Again all NBHSA members named deny Pat's statement, and affirmed that she was never given written or verbal permission to publicize their name (or other private information).

NBHSA will be contacting all persons included on this listing. within the next 24 hours.

Beaufort County Homeschoolers should contact either HSLDA, the Rutherford Institute, or your personal attorney if your name is listed in this packet.

Statewide Alert!

Information:

Colleton County, Dorchester County, and Greenville County School Districts are maintaining home school files on all county resident home schools. Do they have your personal information?

Each district named has confirmed to NBHSA that they do indeed maintain a private file of home school information for those home schools under 59-65-47. They file any copies of members paperwork or copies of confirmation provided by any association to their members that the district obtains.

This abuse can only continue if we as home schools allow it. Surely there are other counties that do the same across South Carolina. Protect your right to privacy, do not allow this abuse and harrassment to continue.

Preparation:

1. Know your rights.
2. Print out a copy of Be Prepared - for When An Official is at Your Door... html or pdf, and place it on the back of your front door.
3. Print out a copy of Be Prepared - for When An Official Calls You on the Phone... html or pdf, and place it by your primary telephone.
4. Familiarize yourself with the SC homeschool Law that you home school under
5. Preserve your personal information by not allowing any officials to copy your association issued paperwork.

Act Now:

1. Take the precautionary steps listed in preparations now to know how to protect your rights later.
2. Do not allow a home visit by any school district.
3. Do not allow copies of your association issued documentation.
4. Review the Questions About Association Issued Documents, which includes information about how HSLDA has helped to stop this abuse in Oklahoma.

Berkeley County Alert!

Information:

Berkeley County School District Coordinator Health Programs for At-Risk Students sent Sangaree Elementary School Social Worker to a Berkeley County military members door!

A Sangaree Middle School Social Worker had a list of names that she was visiting unannounced door to door recently. She informed both the member and the association director of NBHSA that she was under orders from her boss, the Berkeley County School District Coordinator Health Programs for At-Risk Students, not to leave any home school family that she came in contact with, without getting a copy of their association paperwork for the Berkeley County School District Coordinator Health Programs for At-Risk Student's files.

On February 27, 1989, the Attorney General issued an opinion declaring that school districts have no authority to require home visits.

Why was a home visit initiated by Berkeley County School District when the Attorney General has already issued an opinion in 1989, that the school district has not authority to require home visits?

They are required to have permission from the home school before making a home visit and should have obtained such permission before ever leaving their office.

No SC home school is required to submit to any home visit by the school district.

Why does Berkeley County School District have a Coordinator of Health Programs for At-Risk Students assigned to home schools? Is this an implication that homeschools are at risk students?

HSLDA at the request of NBHSA sent a letter dated September 2, 2003, informing Berkeley County School District Coordinator Health Programs for At-Risk Students that they are advising their member families that "they do not have to provide proof of membership in New Beginnings Home School Association or any other homeschool association when contacted by a school social worker. Your efforts to obtain such documentation is unauthorized and nothing more than harassment of these law-abiding families. Home School Legal Defense Association is commited to defending the constitutional rights of parents who have elected to educate their children at home. In most cases we are successful in resolving differences between our members and public school officals without the necessity of litigation. However, when necessary we ascert the civil rights of our members in federal court actions against public school officials and other representatives of the state under 42 USC Section 1983 seeking both damages and reimbusement for legal expenses. Accordingly, I would caution you about proceeding against home schooling families in any manner which would infringe upon the exercise of their contitutional rights as have been expressly recognized by a number of U.S. Supreme Court decisions."
