Alleged rape victim asks court to withdraw charges against boyfriend


A woman who alleged that her boyfriend raped and sodomised her, causing police to institute criminal charges against him, will now have to approach the Director of Public Prosecutions to have the charges withdrawn.

Boyfriend was charged for rape and buggery

Yesterday, when the 30-year-old woman's boyfriend, Sean Cholmondeley, was charged for rape and buggery, she approached the prosecutor to indicate that she no longer wanted to offer evidence against the man.

It is alleged that Cholmondeley raped and buggered the sales clerk on June 23 last at a hotel in Charlotte Street.

The prosecution contended that the two were in a relationship but had separated.

According to the prosecution's case, the accused met the Virtual Complainant on June 23 and forced her into a hotel, where he raped and sodomised her.

After the charges were read to the 23-year-old hairstylist, Magistrate Melissa Robertson-Ogle asked the Virtual Complainant if she is still in a relationship with the accused, and she replied ‘yes'.

His lawyer, Attorney-at-law Sonny Sarwan, told the court that the Lot 322, East La Penitence resident and the VC have been lovers for some time now.

Prosecutor Inspector Maxine Graham subsequently advised the VC that she will have to approach the DPP's chambers and inform them that she does not intend to proceed with the matter.

Magistrate Robertson-Ogle placed Cholmondeley on $50,000 bail.

The case will continue on August 15.
