Francis HEWITT

At a court held for York Co, VA, May 18th 1741 and upon the prayer of Elizabeth Hewit that Francis Hewit deceased without a will; Nathl Buck, John Cosby and John ?Lister? were ordered to make an appraisal of the estate of the deceased.  Appraisal of the Estate of Francis Hewit decd was returned to York Co. Court on June 15, 1741, appraised by John Cosby and John L. ?Lister? and by Eliza Hewit Admd.

Elizabeth, LNU, identified as the widow of Francis Hewitt.

She was not included in the settlement of the estate of Francis Hewit in 7 Sep 1753.

We know she was alive after Francis passed, but she may have passed before the estate was settled.  Since an appraisal of the estate was returned in 1741, I wonder why it took almost 2 years before the estate was settled?

He is named in the will of his mother.  That will is dated 1 Sep 1763.  The will also names grandson James Hubard of Williamsburg (sic VA).

Mathew HUBBARD

The last Will and Testament of Matthew Hubard decd was presented in court by Jane Hubard the Executrix therein named and no witnesses being Subscribed to the same, William Hubard personally appeared in Court and being first Sworn Declared That he found the said Will in the Desk of the Decedant where he had told him the Deponent the same was laid and that he is very well acquainted with the hand Writing of the Decedant and verily believes the said Will and the name thereto Subscribed is all the proper hand writing of the said Decedant Whereupon on the motion of the said Executrix who made Oath according to Law the said Will is Ordered to be Recorded and Certificate is granted her for obtaining Probat thereof in due form.

In the Name of God Amen I Matthew Hubard of York Town being at present in good Health thanks to the Almighty therefore but for settling my affairs in case of a sudden death I do make this my last Will and Testament. Imprimis

I Give and Devise to my three sons James, Matthew & William Hubard the land I bought of Mr. Gwin Reade on the Wind Mill Point be equally divided between them by indifferent persons to be chosen for that purpose and my desire is that my said sons shall take choice according to Seniority This Land I Give and devise to them and their Heirs forever  in severally

Item I give and bequeath all the rest of my Estate after my just and lawful Debts are paid to be equally  divided between my loving Wife Jane Hubard and my four children to wit James Hubard, Elizabeth Hubard, Matthew Hubard and William Hubard.

Item It is my desire that my said sons be kept to school and educated in the best manner their Estates will afford until they respectively Arrive at the Age of Sixteen years and then to be bound out to some lawful calling as my Executrix & Trustees shall think most appropriate and in case the Profits of their Estate be not sufficient to keep them at school til they respectively Arrive at the Age aforesaid Then I desire it may be done out of the Principal

And Lastly I do hereby appoint my Loving Wife Jane Hubard Executrix of this my last Will and Testament and do appoint my  Brothers James Hubard and William Hubard together with my truly worthy friend Mr. Benjamin Waller to be my Trustees to be aiding and assisting my Executrix in the Performance of this my last Will and to advise and direct her from time to time as they shall think most proper in the Execution thereof. In Witness whereof I have hereunto set my hand and seal this ninth Day of May 1844.

Jane BALLARD

Her maiden name is unknown.  She was the widow of Robert Ballard.  (16 Jun 1735 - Wills & Inventories #18, York County, VA page 190).  She married Matthew Hubbard sometime after 16 Jun 1735 and bef 15 Jun 1741.

John Daniel was born 27 July 1816 in Tattenal, Georgia md. 3 Jan 1838 in Lowndes Co., Alabama to Estha Lucinda BELL. and died 28 sept 1898 in Atlanta, Winn Parish, Louisianna & is buried at 1st Methodist Church.

Estha Lucinda BELL was born 27 March 1821 and died 14 March 1896 in Atlanta, Winn Parish, Louisianna. Her parents were: T. Peter BELL and Jency KOLB.

Daniel Huff BURT born 5 March 1839 in Lowndes Co., Alabama, md. 28 Oct.1858 at Fort Deposit, Lowndes, Alabama to Harriet Ann BODDIE, moved to Louisiana and then to Texas.  Died at Snyder, Scurry, Texas 22 Feb. 1919.  He was a Lt.Col. in the Confederate Army and suffered a leg wound from which he suffered the rest of his life.

Most of the older information came from James Claude Burt of Mississipi in 1970.  He had researched the Burt's for over 30 years at that time.  He sent me two wonderful pictures of my great great grandparents, Daniel Huff and Harriet Ann. My father knew Daniel Huff who died when daddy was 9 years old.


Hewitt BURT

Hewitt and his wife Mary's family are shown in the 1850 Hempstead, AR census with the following children:  Hewitt E., 27, Susan, 22, William, 20, George W., 15, and Andrew S., 9. J. S.,30, may have been in college . He and his family appear in the 1860 census.

Hewitt Burt was an elder in the Cumberland Presbyterian Church.
In 1833, also served as a representative to the Arkansas Territorial
Legislature.

John BURT

John was in the Revolutionary War.
According to pages 65, 66 & 67, Will Book A, Edgefield Co., SC, John Burt is identified by will as a son of Mathew Burt. The will, dated 14 April 1794, was proved in Open Court, June Term, 1794.

Francis BURT

Francis resided32 1776 in , Lunenburg Co., VA.
He signed a will33 13 Mar 1836 in Anderson Co., SC. He wrote a Codicil to his will33 8 Jun 1837 in Anderson Co., SC.
At the time of his death 9 Jun 1837, he was listed as being 78
years old.

Francis Burt is identified by will as a son of Mathew Burt. The will, dated 14 Apr 1794, was proved in Open Court, June Term, 1794.

Commissioner of public buildings. Justice of quorum. Member of Baptist Church. Died June 9, 1837, near Pendleton.

Lived with Alfred & Permelia Burt Wight on the 1850 Benton Co., AL census.
On the 1840 Benton Co., AL Census, she is living next door to Martha Wightt, her sister-in-law, and has 3 males and 6 females living with her. One of the females is Permelia Burt.

Dr. Matthew BURT M.D.

Buried in Jacksonville Cemetery. Notice of estate sale printed in the
Jacksonville Republican Newspaper on Wednesday, 14 Apr 1841, p.4 c.5. Listed in the notice are Mary Ann Burt, Widow, O.E. Burt, Erasmus R. Burt, Eliza Burt, Permelia Wight, Mrs. Roberts, Francis Burt and Armstead Burt - brothers and sisters of Matthew. No children were born to this marriage.

Mathew married Mary Ann BURT, daughter of Harwood BURT and Susannah MILES. Mary was born about 1800 in , Edgefield Co., SC. She died after 1860 and was buried after 1860.

Mary was issued a Land Grant 15 Mar 1831 in Edgefield Co., SC.
Mary Ann & Matthew Burt were cousins.  Mary Ann is named as the widow of Matthew in the notice of estate sale in 1841 Jacksonville, AL, after the death of her husband, Dr. Matthew Burt. She apparently lived with her brother, Dr. John Harwood Burt, after the death of his second wife and is shown on the 1860 census in the home of John Harwood Burt in Edgefield Co., SC. Date and place of death unknown.

Oswald BURT

A doctor in the SOUTHERN ARMY during the Civil War. Oswell Burt was the founder of Alexandria, Alabama. He secured Surveyor John Lindsey to lay off the town in lots. The land plat was drawn in 1836. The plat was filed on July 2, 1836, and was a rival with Drayton for the Co. Court House.

Oswald married Nancy RAIFORD on 15 Jun 1823 in , Edgefield Co., SC. Nancy was born about 1800 in USA.

Pendleton (SC) Messenger of June 4, 1833 stated that Rev. M. Manby performed the marriage.
