THE ADMINISTRATIVE PROCEDURE LEADING TO THE OBTAINMENT OF A VISA AND WORK PERMIT

1. Obtainment of preliminary work permit (7-8 weeks)

2. Obtainment of a multi-entry work visa from a Polish Consulate abroad

3. Obtainment of a final work permit (2-3 weeks)

1. Obtaining a preliminary work permit.

At this stage the employer who wants to employ a foreigner should forward to the territorially competent Voivodoship Labor Office, the following documents:

- a photocopy of a document confirming the professional qualifications of the foreign person, together with a registered Polish translation;

a photocopy of the statistical number (REGON) of the employer;

a photocopy of the tax identification number (NIP) of the employer;

a current excerpt from the commercial register of the employer;

a photocopy of the first page of the foreigner's passport ;

a certificate of registration of the foreigner's stay in Poland ( address of the place of residence in Poland - " meldunek" );

the opinion of the Labor Office on the submission of an offer for the proposed posts, declaring that there is a lack of Polish candidates for this post. This does not concern managerial posts in the Company.

The Voivodoship Labor Office has its standard application form to be filled in by the

job title
post to be held
place of the performance of work
level of proposed remuneration
required qualifications: education, experience in certain post, specialization etc.,
date of commencement of employment
short description of the work performed

and additionally the information regarding the foreigner ;
his/her first names and the second name
his/her parents' name
his /her mothers' maiden name
his/her address abroad

The permit is granted for a period not longer than 12 months.

Offer of employment

Before the submission of an aplication to the Voivodship Labor Office by the employer

for permit to employ foreign persons, it shall be necessary to obtain the prior declaration of the Labor Office that the employer had previously submitted an offer to the Labor Office to employ Polish nationals in these posts but there is a lack of Polish candidates. Such opinion is granted within 3 weeks.

2. Obtaining a special visa.

The permit constitutes the basis for the foreigner's application to the Polish Embassy or Consulate abroad for work visa.

To receive such a visa the following documents should be submitted to the Polish Embassy or Consulate of the country where foreigner has a residence address:

the original of the preliminary work permit
passport
two(or one) passport photographs
a completed visa requestst form (available at the Consulate)

The same procedure applies to members of the family of the foreigner who are to stay in Poland together with him.

3. Obtaining a final permission for employment.

To obtain such a final permission the following documents should be submitted to the Labour Office:

passport with the visa stamped therein
copy of the preliminary work permit
proof of payment of a fee to the Labor Fund by the employer
photocopy of the payment slip
a certificate of registration of the foreigner's stay in Poland

An employer who obtained a preliminary permit as mentioned in point 1 must make a single payment to the account of the Labor Fund of the Voivodship Labor Office which issues the permit, in an amount being the equivalent of the minimum wage, for each person covered by the permit. The value of the payment (the minimum wage) amounts to 500 PLN and is revised quarterly.

The Polish law requires the obtainment of a final work permit prior to the commencement of employment by the foreign person.
