I concur with your instincts on this.  Back a couple of months ago, 
the pentagon floated this "cinc" change once.  It made my neck hair 
stand on end.  Back a couple of years ago Joseph Farah commissioned 
a detailed examination of the posse commitatus act question.  The 
researchers concluded that any protective limits were entirely 
mythical.  The power to act through the executive is in no way 
stemmed nor reviewable by the judiciary.  And we all know what 
guardians of liberty the legislative branch affords.  The only thing 
that prevents absolute tyranny today is a combination of inertia, 
turf wars, and lack of resolve, on the part of our "leaders".
