Dear Lying, History-ignorant, Power-abusing, Oath-breaking, Authority-worshipping, Mealy-mouthed Judge Tolby,

The Arizona Republic's editors don't have the balls to print this letter, so I've included a number of Real Americans in this communication -- including several hundred in "blind carbon copy" -- to make sure it gets around.

I read with amazement and disgust your opinions in Arizona Republic newspaper:

Along with your braggadocio demeanor at having abused your place of power by wrongfully convicting an innocent man for merely possessing a firearm, I foundtwo of your false public statements to be particularly contemptible. You said:

"LESSON: If you carry a gun in your car, you had better have a permit and have it in plain view..."

According to the statutory laws of Arizona, your Opinion that someone who has an Arizona permit to carry a concealed weapon cannot legally conceal it in his own car is incorrect. You'd do well to study the statute you have wrongly and publicly misquoted.

I was also fascinated to see you say this:

"Very plainly, he law says do not have a weapon within your reach that is concealed inside a car."

No, it doesn't. What STATUTORY LAW -- which is subject to constitutional validity and repugnant if it doesn't meet muster -- says is:

2. Carrying a deadly weapon without a permit pursuant to section 13-3112 concealed within immediate control of any person in or on a means of transportation; or http://www.dps.state.az.us/ccw/3102.htm

And then it offers the exemption you violated recklessly by wrongfully levying a fine against a citizen:

Subsection F.

"Subsection A, paragraph 2 of this section shall not apply to a weapon or weapons carried in a case, holster, scabbard, pack or luggage which is carried within a means of transportation or within a storage compartment, trunk or glove compartment of a means of transportation." http://www.dps.state.az.us/ccw/3102.htm

His gun was in a holster, Tolby, and the Constitutions State and Federal protect his keeping and bearing arms regardles of any statute, you illiterate buffoon:

"A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed." (Bill of Rights, Second Amendment, Ratified in 1791, and still the Law of the Land)

"The right of the individual citizen to bear arms in defense of himself or the State shall not be impaired..." (Arizona Constitution, Article 2, Section 26) http://www.azleg.state.az.us/const/2/26.htm

Your opining in the public media in direct contradiction to the laws of the State of Arizona leads me to conclude that you are unfit to serve as a judge over such cases. We will be watching for a public retraction of your false statements, accompanied by your letter of resignation.

And, by the way, Your Dishonor, unless and until you issue a formal apology for misrepresenting the facts, impugning the character of decent gunowners and for violating your oath of office, I am standing here in utter and complete contempt of your court. Chuckle on that.

Finally, you said:

"The officer drew his weapon and ordered the driver out of the car."

Mr. Oath-breaking copper would be well-advised not to pull his gun on a Patriot; American citizens' rights are inalienable, and that does include any and all circumstances where some over-testosterated anti- Constitutional-rights goon with a badge tries to abuse them. Chuckle on that, too.

Oh, and Judgy Boy, I noticed that judges are not exempt under that unconstitutional statute (13-3102) from carrying concealed weapons without a permit. So answer me the million dollar question: Would that oath-violating copper have drawn his gun on you? Hell No he wouldn't have. Why might that be? You better than We The People, son? NO you're not; you are my SERVANT. You can start serving me by resigning; we'll replace you with someone who doesn't have his head up Sarah Brady's ass.

Learn what the constitution is all about, or pack your bags and move to China and take that anti-rights cop with you.
