You've got it all wrong.

Let's say you want to put a bald eagle on your website, to show that you are an American. The bald eagle is not trademarked. But let's say instead of any bald eagle image, you put the eagle that is on the Presidential Seal on your website.

The office of the President might have a problem with that. They would surely send a letter to you, telling you to remove the image.

Same deal here. They did not post just any maple leaf, but the red one with two red rectangles on either side of it -- no black border, no drop shadow, no color gradient. As it turns out, the 'flag' that the FORCES site posted looks identical to the flag logo used by EVERY Canadian Federal Government department (i.e http://www.hrdc- drhc.gc.ca/). This flag style can ONLY by used by FEDERAL GOVERNMENT AGENCIES!

Do you see how that might be confusing? A pro-smoking website that some Canadians may (mistakenly) think is affiliated with a FEDERAL GOVERNMENT AGENCY?

Now, I'm sure if the FORCES people posted a stylized flag or an animated gif of a Canadian flag flowing in an electronic breeze -- there would have been no problems.
