Feb. 23, 1878 "To the Honourable The chief Justice or one of the Honourable The Assistant Justices of the Supreme Court of Newfoundland
The petition of James Martin nd his wife Mary Ann Martin of St. John's Humbly Sheweth that William Brace late of Quidi Vidi in Newfoundland fisherman father of petitioner Mary Ann Martin died at Quidi Vidi aforesaid about nineteen years ago
That at the time of his decease he left him surviving seven children namely Susan, William, Mary Ann, John Jane Richard and George. That George John Jane and William are since dead.
That Susan and Richard left Newfoundland, Richard about eleven years ago and Susan about Seven years ago and have not been heard of since. That all said children were ---------- excepting Susan whose husband Henry Crowley was drowned leaving him surviving two children now under age, and and your petitioner Mary Ann Martin.
That at the time of the decease of the said William Brace father of your petitioner Mary Ann Martin he was possessed of land, dwelling house and property of the probable value of Two Hundred dollars situate at Quidi Vidi aforesaid within the jurisdiction of your Honorable court. That no probate or administration to said estate has been granted and that one William Head of Quidi Vidi Gate-man? has been in the possession of the said estate and has been collecting the rents and profits therefrom for and dwelling the past nineteen years. And alleges to have in his possession a paper writing purporting to be a last will and testament of the late William Brace Senior. And has appeared as deponent in ----- and deliver by ------ to petitioners application for Administration
That your petitioner the said Mary Ann Martin is the only surviving child of the said deceased William Brace in Newfoundland And that the said William Brace died interstate excepting the alleged writing aforesaid. Petitioner therefore pray that the said William Head may be ordered to bring unto the office of the chief clerk and registrar of the Supreme Court - the said paper writing purporting to be testamentary of the said William Brace ----- and deposit the same therein - And would said testamentary be valid that they may be granted Letters of administration ---- testaments ------ othermore administration to said estate And in duty bound they will ever pray His X Mark James Martin Her X Mark Mary Ann Martin"
