Will of Daniel Bythewood

Notes for DANIEL BYTHEWOOD: In the name of God Amen The sixth day of March in the sixth year of the Reigne of Our Sovraign Lady Queen Anne by the Grace of God of Great Britaine France and Ireland Queen defender of the faith Anno Dom 1707 Daniel Bythewood sen. of Dorking in the County of Surrey being of perfect mind and memory praised be to God therefore and considering the uncertainity of this transitory lifre doe make and declare this my last Will and Testament in manner and forme following Wherein I first bequeath and yield up my soul in the hands of Almighty God my Creator that gave it me And my body to the earth that at the Resurection hopeing through the Meritorious death and passion of my only Saviour Jesus Christ and by no other means to have full pardon and remission of my sins And to enjoy eternal life in the Kingdom of Heaven And I Will that my body be decently buried by the descretion of my hereafter named And as touching and disposing of all such lands tenements goods and chattells which it hath pleased God to bless me withall I give devise and bequeath and dispose of in the same manner and forme following In Primis I give and devise unto my loving Wife Elizabeth Bythewood all my houses lands and tenements whatsoever during her Natural Life and after that to be disposed of as I shall hereafter Mencion Item I give and bequeath unto Daniel Bythewood my oldest son One Shilling to be paid to him by my within one month next after my decease Item I give and bequeath unto John Bythewood my youngest son twenty shillings to be paid him by my within one Month next after my decease Item I give and devise unto my daughter Elizabeth Bythewood and her heires forever all that my house tenement now in the occupacon of Edward Sayer of Dorking in the County of Surrey blacksmith Item I give devise and bequeath unto my daughter Jane Bythewood and her heires forever All that my messuage or tenement now in the tenure or ocupacon of Nathanel Bradley of Dorking in the County aforesaid Item I further give and devise unto my daughter Jane Bythewood and her heires forever that messuage or tenement now in the tenure or occupacon of John Rose of the County of Dorking in the County aforesaid husbandman with part of the Orchard thereto adjoining Item I give and devise unto my daughter Sarah Bythewood and her heires forever all that Messuage or tenement built or to be built on the other part of the Orchard where John Rose aforesaid now dwelleth Item I give and devise unto my daughter Mary Bythewood and to her heires forever All that my messuage or tenement now in the tenure or occupacon of Denier Widow of Dorking in the County aforesaid And my Will and Meaning also is that if one or more of my daughters shall dye without of her or their own body or bodyes lawfully begotten that all what I have given the said daughter or daughters shall be equally divided among the surviving sisters or sister Item I give and devise unto my Grandson Samuel Bythewood son of John Bythewood aforesaid All that my house or messuage barnes stables and Orchard with the happertonces thereunto belonging situate in the parish of Cranley in the County aforesaid and now in the tenure of Thomas Risbridger And my Will and meaning is further that if the said Samuel Bythewood shall happen to dye before he shall arrive at the respective age of one and twenty yeares That then I give and devise the said messuage and tenement with the barnes stables and Orchard which I gave and devised to my Granson had had he lived to my daughter Jane Bythewood and to her heires forever if she shall happen to dye without heires the same to be divided among the surviving sisters as aforesaid Item I further give and devise to my Loving Wife Elizabeth Bythewood dureing her life after my decease six pairs of the best sheets two tablecloths eighteen napkins and the best Bedd with the furniture thereunto belonging also one pottage pott two kettles twelve pewter dishes twelve pewter plates with all things fit for the furnishing of a roome All which goods after the decease of Elizabeth my Wife shall be valued sold and equally divided between my daughters And my will and meaning is that all my stock both of Trade and Farmeing with all bonds bills and book debts with five silver cupps and twelve silver spoons after my decease to be valued and sold by such men as my Overseers in Trust of this my Will shall think fitt and approve on And that after my debts Legacies and funerall expences shall be fully satisfied contented and paid

John Bythewood appeared in person and he testified that Daniel Bythewood late of the parish of Dorking in the County of Surrey died two years ago but while he lived was of sound mind and in his healthy and perfect memory and that he made and ordained his testament in writing containing his last will bearing date 6 March 1707 lawfully and in due form in which he truly named and appointed the following executor the aforesaid John Bythewood who was the natural and lawful son and the next of kin of the said deceased and the legatee named in the said will. Wherefore he requested letters of administration of all and singular the goods debts and credits of the said deceased in his said will annexed and we have produced granted and entrusted the same to him following his plea in this business and the right etc. He was sworn to administer truly and faithfully etc. and that the goods etc. of the said will did not extend to the total of 20 pounds
