THE WILL OF JOHN TALBOT ALIAS PARKER OF WHISTON
This translation will seem primitive but the indistinct print, the mixture of French, Latin and old English make it very difficult to decipher. Technically this is not a Will, rather an administration of the property of John Parker who died intestate in 1717. It was on a pre-printed filled in with the necessary details. People mentioned first at the top of the form are the interested parties The first twelve lines appear to be a hybrid legal language using both French and Latin vocabulary. Even then many of the words have been poorly interpreted or spelled. Spaces are indecipherable words. Huge gaps mean line of completely undecipherable text! Thomas Hurst de Prescot Butcher obligani Rosamunde in Christo Patri et misiono divina cormentis libris bonce et legalis monata Magna Brit attornat executor? et Administrator said to quam quid bene obligamus qual ibet unnus poux prooto insolids DomoExecutir et Administrator nous et meum progenitor perpsoutas Sigillus unis Sigissat dal Decino Nono Novembiri Regni Georgi Magna Britanic et Anno Dec? 1723 The next 29 lines are 18th century English but with the influence of languages like Spanish (as in the word "Condicon") which has the tilde (~) over the second "c". The Condicon of this obligaron is such that if Rosamunde Metcalfe wife of the above bounder John Metcalfe administrator of all and singular the goods and chattels, etc... of the said John Talbot alias Parker late of Whiston in the said county... do make... to be a true and perfect inventory of all and singular the goods, chattels, etc... of the said deceased which have or shall come to the hands, possession or knowledge of her the said Rosamunde or into the hands and possession of any person or persons for her and the same... made or cause to be exhibited into the Registry of Chester... at or before the nineteenth day of February next ensuing. And the same goods, chattels and... and all other goods and chattels and... of the said deceased at the time of his death which at any time after shall come to the hands of possession of the said Rosamunde... or into the hands and possession of any other person or persons for her do well and truly administer according ... And further be made or cause to be made a true and first attempt of her... at of before ye nineteenth day of November 1724. And all the rest and residue of the said goods chattels and... which shall be found remaining upon the said of the same Administration attempt the same being first examined and allowed of... the Judge or Judges for the time being of the said court shall... and pay unto such person or persons respectively as the said Judge or Judges by his or their decree or sentence...to the same true intent and meaning of the late Act of Partliamound in the two and twentieth and three and twentieth years of the raigne of the late Soveraigne Lord King Charles the second. (....An act for the better settling of intestates (estates) shall limit and appoint. And if it shall hereafter appear that any last Will and Testament was made by the said deceased and the Executor therein named do exhibit the same into the said court making request to have allowed and approved accordingly if the said Rosamunde being there and deliver unto required to... and deliver the said... approbacon of such testament being first hand and made in the said court. Then this Obligacon be void and of none... or else to remain in full force and virtue.

Notes:- The Oath Rolls of 1696 mention John Parker of Whiston. John Parker of Whiston was buried in 18 December 1717 at Prescot. Margaret Parker Widow of Whiston was buried 18 March 1722 at Prescot. Children to John Parker of Whiston - Rosamund baptised 22 July 1683 at Prescot, - Lydia baptised 6 December 1685 at Prescot. There is no explanation as to the nature of or reason for John's alias.
