Pitcairn bar shut for week By Karen Zapf Pitcairn bar shut for week after fights - Pittsburgh Tribune-Review PITTSBURGH TRIBUNE-REVIEW Tuesday, March 20, 2007 An Allegheny County judge on Monday granted an emergency injunction that closed Churchfield's bar in Pitcairn for the week. Sheriff's deputies padlocked the Broadway Avenue bar Sunday after Judge Robert P. Horgos signed a preliminary emergency order sought by the District Attorney's Office. A hearing is scheduled for Friday before Horgos. During the past year, Pitcairn officials have complained about noise and fights at Churchfield's. They sought assistance from the district attorney to have the bar declared a nuisance and shut down. The prosecutor's office said records show police responded to 49 calls to Churchfield's in two years, for incidents including narcotics trafficking, assaults, disorderly conduct and two homicides -- one of them in the bar on Jan. 16. Damile Qwi "Ace" Mitchell, 26, of Monroeville, and Amanda Ofcansky, 27, of White Oak, are charged with criminal homicide in the death of Donald Wertz, 45, who lived in an apartment above the bar. Wertz was shot three times. On March 9, Churchfield's and two other Pitcairn bars -- Barry's and the Sharwood -- were raided by the county's Nuisance Bar Task Force and the District Attorney's Narcotics Enforcement Team, who were looking for more than two dozen drug suspects. Pitcairn Council President Orelio "Rollo" Vecchio applauded yesterday's court action. "We pushed for this goal for a while," Vecchio said. The bar has operated under "temporary authority" after the state Liquor Control Board in January refused to renew Churchfield's liquor license, said Sgt. John Kean, district office commander for the State Police Bureau of Liquor Enforcement. The LCB cited eight incidents of disturbances at Churchfield's since June 2003, including fights, assaults, a drunken employee and an assault on a police officer, according to court papers. The owner, Heather Cigrand, appealed the LCB's decision. A hearing is scheduled for April, her lawyer, Louis Caputo, said. "Her position is she doesn't feel she is operating the bar as a nuisance establishment," Caputo said. Shortly after the shooting, police received a tip that the shooter was in a room at the Days Inn on Mosside Boulevard in Monroeville. Police told Channel 4 Action News the suspect's name is Damile "Ace" Mitchell, 26. Police contacted him but they said he refused to surrender right away. The Allegheny County SWAT team was called to assist and Mitchell did eventually come out of his hotel room after several hours. He was taken into custody and is being questioned but has not been charged. The shooting victim, Donald Wertz, 45, was taken by ambulance to Mercy Hospital in critical condition. Sources tell Channel 4 Action News he was shot once in the knee, once in the head and suffered a defensive wound to his hand. Police said Wertz lived above the bar where he was shot and was well-known in Pitcairn.
