AROUND 3:30PM (AFTER A LATE LUNCH) LOGAN AND BRISCOE RETURN TO THE NAPOLEAN HOTEL. BEFORE ASKING TO HAVE KENNKONG PAGED AGAIN, THE DETECTIVES ASK THE CLERK WHO WAS WORKING THE DOOR AROUND SIX PM LAST NIGHT, THE CLERK POINTS OUT EUGENE Logan: Were you working this door around 6pm last night? Eugene: Yes Sir! Logan: Is the only entrance for guests to go through? Eugene: Yep! Briscoe: Did you see this girl (showing the picture) go through this door with any man last night while you were working? Eugene: Not through this door sir! Logan: $hit! Eugene: I did escort her to and through the employee door in the back which leads to the ally! Briscoe: Just her? Eugene: Yes Sir! Logan: Who made you do this? Eugene: My boss, Mr Noth! Briscoe: Why didn't Mr. Noth do it himself? Eugene: You need a key to unlock the door and he had clocked out. ENTERING KENNKONGS OFFICE, BRISCOE AND LOGAN TAKE HIM INTO CUSTODY AND READ HIM HIS MIRANDA RIGHTS. TWENTY MINUTES LATER (DUE TO TRAFFIC) LOGAN AND BRISCOE HAVE KENNKONG IN AN INTERROGATION ROOM AT THE STATION Logan: So are you going to stop screwing around with us and tell us what you know about the death of Joystar? KennKong: Who is that? Briscoe: It's the women that you had Eugene escort through the back employee door to the ally where you picked her up and took her out! The same women we found dead in you basement Mr. Noth! KennKong: I want my attorney! ONE HOUR LATER, CLAIRE (THE GODDESS OF L&O) SHOWS UP AT THE STATION AFTER KENNKONG AND HIS ATTORNEY HAVE FINISHED DISCUSSING THE POTENTIAL CHARGES AGAINST HIM OF MURDER! Claire: (To Logan) So why have we arressted this man for an apparent suicide? Logan: Were not sure it wasn't a forced suicide and this guy hasn't been straight with us at all! Briscoe: He has been lying from the onset! CLAIRE ENTERS THE INTERROGATION ROOM WITH LOGAN AND BRISCOE AFTER A KNOCK ON THE WINDOW Mr. Dixon: Hello Ms Kincaid, I'm Mr Noth's attorney and he is now willing to cooperate in order to clear up this misunderstanding! Claire: I'm Waiting! KennKong: Look, My wofe was out of town for a few days. I'm human! I met Joystar earlier in the day at work and I asked her out for the evening because I didn't think my wife was getting back until today! We went out and had a wonderful time! Then I asked her if she wanted to come back to my place and she accepted my invitation. When we got back to my place we had a few more drinks and then started to fool around! Then unexpectedly I heard my wife's car pull into the driveway. I had to tell Joystar the truth! I asked her to go into the basement and wait until my wife was asleep and I came to get her! As I was rushing her down the stairs to the basement, I saw her take some pills with her wine! I didn't know what kind of pills they were! Claire: Some Pills Mr Noth! She had over 20 in her stomach! You didn't think that was strange her taking that many pills! KennKong: I wasn't watching that closely, I saw her take alot of pills as I was rushing her intoi the basement but, I was distracted! My wife had came home unexpectedly! her taking a pills was the least of my problems...I was trying to save my marriage! Claire: Then what? KennKong: Well around 1 am my wife fianally was sound asleep and I went to the steps of the basement and called for Joystar! She didn't answer so I assumed that she had got out earlier in the evening while my wife and I were distracted! Claire: So you didn't see her on the floor? KennKong: I never turned on the light, I didn't want to wake my wife! Mr. Dixon: See Ms Kincaid, my client has cooperated and other than cheating on his wife, he did nothing to affect the womens actions and her death! So can my client go home to his wife? Claire: That's just it Mr Dixon, your client didn't do anything, and in this state that is MANSLAUGHTER! KennKong: WHAT! KENNKONG IS TAKEN AWAY AND ARRAIGNED LATER THAT EVENING! THE NEXT DAY IN ADAM SCHIFF'S OFFICE Jack: DO you really think we can make this manslaughter charge stick in court? Claire: This man admits seeing Joystar take the pills and he just let her do it! All he was concerned about was hiding his infidelity from his wife! KennKong let a women die because he failed to get her a doctor because if he would of done so his wife would havrriage would probably be over! Jack: But Mr Noth doesn't have to stop this women from commiting suicide! The fact that this women was in the defendant's house created no legal duty which requires him to help this women and stop her from commiting suicide! He has no contol over the women's actions, regardless is she is in his house or in Wolf park! Claire: But his lying to her is the reason she commited suicide Jack! Adam: Save it for Philosophy class! Just get a conviction or drop the case! THE CASE DOES GO TO TRIAL AND YOU ARE THE JURY! SHOULD HE BE CONVICTED OF THE CHARGE AGAINST HIM>>>MANSLAUGHTER? WHY OR WHY NOT?
