BRISCOE AND KENNKONG RETURN TO THE LIVING ROOM. BRISCOE WHISPERS TO LOGAN ABOUT WHAT HE HAS JUST LEARNED. IN ADDITION, LOGAN AND BRISCOE SEND ONE OF THE FORENSICS DETECTIVES WHO HAVE REARRIVED UPSTAIRS TO THE BATHROOM FOR A SAMPLE OF THE BLOOD THAT MRS. KONG WASHED OFF IN THE MORNING. 


Logan: Mrs. Kong, Did you ever figure out where the blood on your leg came from? 
Lennie's Lady: No...Why? 
Brisco: I can't seeany cuts on your legs? 
Logan: Do you have any idea where the blood came from? 
LL: No! 
KennKong: What are you implying detectives? 


ALL OF THE SUDDEN THE FORENSICS OFFICER ENETRS THE ROOM AND CALLS FOR THE DETECTIVES. BRISCOE HEADS OUT OF THE ROOM TO TALK WITH THE OFFICER... 


Officer: We found some of the blood in the drain and from what we can tell, it's not Mrs. Kongs! It is the same blood type as Mike's Fan "A+"! 
Briscoe: What's Mrs. Kong's type? 
O: Type O! 
B: Thanks! 


BRISCOE ENTERS THE ROOM AND NODS AT MIKE... 


Logan: Mrs. Kong...You are under arrest for the murder of Mike's Fan Kong! You have the right to remain silent, anything you say or do .... 
KennKong: What's going on here?!!? 
Briscoe: Step back Mr. Kong! 


LENNIE'S LADY IS TAKEN DOWNTOWN AND THEN ARRAIGNED! SHE IS CHARGED WITH THE MURDER OF HER DAUGHTER AND THE ATTEMPTED MURDER OF NAPOLEAN BONAPARTE. IT IS CONFIRMED BY FORENSICS THAT THE BLOOD FOUND IN MRS KONGS BATHROOM WAS HER DAUGHTERS AS WELL AS NAPOLEANS. IN ADDITION, MINUTE TRACES OF BLOOD WERE FOUND ON HER NIGHT GOWN AND THE TRACES MATCHED PERFECTLY WITH HER DAUGHTERS AND NAPOLEANS DNA AND BLOOD TYPE. LENNIE'S LADY HIRES L&O NUT TO BE HER ATTORNEY. 


LATE THAT EVENING IN ADAM SCHIFF'S OFFICE... 


Adam: So what do we have? 
Claire: We ahve a crazy mother who decided to chop her daughter and her boyfriend in two during the middle of the night for disobeying her wishes with an antique axe! Apparently they were making to much noise! 
Jack: Do we have a solid case? I mean the blood in the bathroom, who's to say it didn't happen when the daughter was shaving her legs or something! 
Claire: She has her own bathroom! 
Jack: I don't know! It just appears to easy! 
(Knock on the Door) 
CLERK WALKS IN AND HANDS ADAM SCHIFF A FORM... 


Adam: It appears as if it won't be as easy after all! (handing the form to Jack) 
Jack: Dismissal! What the hell is this crap! 


AFTER SHOWING CLAIRE, JACK AND CLAIRE SHOCHED BY THE RECENT DEVELOPMENT DECIDE TO BLOW OFF SOME STEAM BY GOING TO HAVE DINNER AND A FEW DRINKS. (WHAT HAPPENS NEXT DEPENDS ON YOUR VIEW OF THEIR RELATIONSHIP) THE NEXT DAY CLAIRE AND JACK ARRIVE IN JUDGE VMOORE'S CHAMBERS TO DISCUSS THE MOTION FOR DISMISSAL. L&O NUT IS ALREADY IN THE JUDGE'S CHAMBERS... 


VMoore: Now that everyone is here, lets get started! 
Jack: Your honor, this dismissal charge is ludicrous! 
L&O Nut: Your honor, it is one of the fundamental principles of our criminal justice system that there can be NO criminality in the absence of criminal intentions! 
Claire: So just because she didn't think she was doing anything criminal means that she should be allowed to do whatever she feels? 
L&O: No, but the differnce that makes this case special is that my client wasn't thinking at all! 
J: Are you claiming that your client was insane at the time of the murder? 
L&O: No I'm claiming that she wasn't thinking at all! 
C: So she was insane! 
L&O: No, She was sleepwalking! 
J: WHAT! 
L&O: Here your honor. (Handing VMoore some medical records) My client has a long history of sleepwalking which is confirmed in these medical reports by Dr. Adrienne! 
C: Your honor! You can't seriously be considering this ludicrous motion? 
V: yes I am Ms Kincaid! 
J: Your honor, allowing this to occur is creating a slippery slope of future problems! You would allow sleepwalking to be a scapecoat for ant type of crime! Oh, I was doing drugs, I didn't know I must have been sleepwalking again! 
V: I think you are over exagerating Mr McCoy! 
C: Even if she did sleepwalk, I've never heard of any sleep walkers taking an axe and killing someone because of a dream! 
L&O: I disagree Ms. Kincaid! In Fain v. Commonwealth a defendant was aquitted of killing his wife when he had strangled her during one of his sleepwalking episodes and he thought he was back in Vietnam and she was trying to kill him! 
J: Yes your honor, but even in Fain the actual decision about the case was by the jury and not the judge. Thats all we ask here! 
V: Your right Mr. McCoy! This case will go to trial! 
L&O: Your Honor, We at least ask that you make it very clear to the jury that there must be criminal intentions in order to have a criminal offense! 
V: I will! Thank You and I will see you in exactly two months!
