Our second feature ( yes that's right, second. I've been busy OK!) once again concerns your paycheck. If your municipality is anything like ours, they cut corners anyway they can to balance the budget. Our City is currently faced with a $15,000,000 deficit. That's a 1 and a 5 followed by six zeroes! It appears that our fair burg is attempting to fill this rather sizable hole by shaving pennies off of our officers' overtime rate. This is where the FLSA link on the Link page comes into play. According to the Department of Labor, your overtime rate MUST include all remuneration you receive as pay. That includes shift differential, longevity, college credits, etc. Anything that is a non-discretionary bonus. Our City is applying the FLSA threshold for overtime for police officers so they do not have to pay time and a half until after 86 hours in a pay period. However, our City is paying officers at a lesser rate which does not include shift differential or longevity for the overtime hours that lead up to the threshold. Our current contract clearly states such items should be inlcuded in our base salary. While this may not be entirely an FLSA matter, it has clearly been educational as far as what agencies and rules govern what portion of your paycheck.
