~IN DAVID'S WORDS~
REMONSTRATING ALTERED PROSECUTION

For years, I have struggled with myself trying to answer a question I barely understand; "WHO DOES JUSTICE REPRESENT" and I finally came to the reality that it represents everybody and nobody. Allow me to elaborate. There are numerous laws in place that supposedly safeguard bias, prejudice, and unfair persecutions, yet, these safeguards only protect a selected few and not the intended masses as it appears to. However, none of these safeguards were afforded to me, in light of the paltry, inexperienced court appointed lawyers I was forced to use at trial. To them, I was just another expendable, underprivileged illiterate who deserved no competent legal representation at all. Indeed, both court appointed shysters only saw my grandmother as just another poor, old black woman who was killed and a worthless grandson being charged for her death.
If unfortunately accused of a serious capital crime, two lawyers to be highly cautious of are Michael Benjamin Roberts (Waco, TX) and Reed Jackson (Fairfield, TX). Over then character witnesses were ready, willing, and able to testify on David Hicks' behalf at trial, including the entire girls softball team that David has preciously coached, even family members, so say good things about his nature and character. But, none of these witnesses were ever called to trial. Why? Mike Roberts claimed it would cost the town of Fairfield too much money so they decided not to call any of them. Even potentially valuable evidence found at the crime scene was suppressed by these two lawyers. There was no strategic advantage to be gained by failing to call these numerous character witnesses, including family members, but a great deal to be lost. The horribly inadequate assistance of counsel that David Hicks received at trial is overwhelming. Indeed, both phlegmatic lawyers were more concerned with how much money they would make off the case than they were in defending David's rights. So much bias and racism did David Hicks receive from the two mentioned uncivil, indifferent, unwilling and ill-equipped court appointed trial lawyers.
However, I will admit that I was socially illiterate to the everyday occurrence or functioning of this judicial system because, had I known, I would not have been so cooperative in allowing my life to be slowly drained out of me by a system (at the time) that needed a scapegoat, and I was it. It was hard to sit in a courtroom being accused of things that you know are lies. Yet, I was unafraid because my defense lawyers gave me the indication that they would secure my freedom from this charade that I was being ostracized with. All of this without having to take the stand in my own defense as I would have liked to have done but was encouraged not to because of trial lawyers tactics. The law states that an accused person cannot be considered guilty. Every rational minded person would expect anyone who claimed to be innocent of a charge against himself to stand up and defend themselves. By not doing so indicates to a jury of reasonable individuals the accused is hiding something. The prosecuting attorney knew this, so did my lax court-appointed lawyers. They all knew this except injudicious David Hicks. A five day mockery of a trial ensued and at that time the jury decided that I need to be exterminated. So, I was sent to Texas' Death Row in February, 1989.
I would give anything to reverse what happened to me over ten years ago because I am older, more mature, and I know how to deal with that type of situation. One thing, I have learned about vile court appointed lawyers who intentionally disregard a persons right during trial is that they are always going to defend their position. They become very shrewd when it comes to justifying a firm position on an individual to get away with whatever their desire is. Both lawyers who represented me at trial have since stated their beliefs of my guilt, now, being the lynch men who are calling for my death. Being railroaded by a system of professional criminals who make their living off the suffering and humiliation of others... this is what David Hicks sustained by the subversive legal representation of Mike Roberts and Reed Jackson.
