PEEVEY deceased, who was in his life- time administrator of DIAL PEEVEY, by virtue of which he is now administrator of said DIAL PEEVEY. Your petitioner further represents that the following described tract of land belonged to the estate of said DIAL PEEVEY, dec'd, and that it cannot be equitably divided between he heirs of said DIAL PEEVEY,dec'd, without a sale. That in the year blank the said DIAL PEEVY removed to the State of Arkansas, and there died intestate, leaving a large property in that state, consisting of land and negroes and other property-that the said DIAL PEEVY also left considerable property in this state consisting of land and notes and other property-that WADE PEEVY, administered on said DIAL PEEVY'S estate in this County-that said WADE PEEVY died in the year blank and now one ROBERT W. PEEVY to complete his bond and to appear on a citation, which is here asked and to show cause, why said pettioner distributive should not be given unto him, and how he has settled said and on failure of his giving bond to remove him, and appoint some other person in his stead, to have said estate finally settled, and distribution thereof made according to law. ARKANSAS

State of Arkansas County of Crawford I Tilman Peevy of said County and State do hereby make my Last will and Testament in Manner and form following that is to say. 1st I desire that my Executors herein after named shall immediately after my decease take and sell at private sale enough of my perishable property to pay and satisfy my just debts and funeral expenses. Should the perishable part of my property prove insufficient for the above purposes, then I desire that my executors may sell enough of my real estate and out of the money arising there from pay and satisfy such of my just debts as my remain unpaid. 2nd After the payment of my debts and funeral expenses, I give my wife Annie Peevy the balance of all my estate both real and personal for and during the term of her natural life and after her decease, I give the same to my children herin after mentioned to be divided amongst them as follows and to be enjoyed by them forever. 3rd I desire that after the decease of my wife Annie Peevy my executors shall sell all my estate both real and personal of what nature or kind ever it may be, at private sale according to the best of their judgment thereby saving the unnecessary expenses of private sales, and out of the money arising there from, I give and bequeath to my son Matthew B. Peevy in trust for my two grandsons Bennett H. Edmonds and John William Edmonds two hundred dollars for their benefit to be used by him in raising them and educating them. 4th I give and bequeath unto my son Gilbert Washington Peevy one dollar. 5th I give and bequeath unto my daughter Angelina one dollar. 6th I give unto my daughter Elizabeth Jane one dollar. 7th I give unto my daughter Minerva Catherine dollar. 8th I give unto my daughter Francis Adeline dollar. 9th And not forgetting but being mindfull of the kindness and patience with which my daughter Abigail wife of John C. Betten and my son Matthew B. Peevy have stood by me and ministered to my wants during my sickness and suffering I hereby give unto them the balance of all my estate both real and personal moneys arising there by virtue of(page folded under) by my executors to be equally divided between my said daughter Margaret Abigail and son Matthew B. Peevy which I give to them, their heirs, executors, administrators and their assigns forever. 10th And lastly, I do hereby appoint and constitute my son Matthew B. Peevy and my son in law John C. Betten executors of this last will and testament, and I do hereby revoke any and all other and former wills or testaments set by my hand this 19th day of December 1876. I JOSEPH PEAVEY SEN of the State and County aforesaid, being weak in body but of perfect mind and memory but knowing that it is appointed for all men once to die, do make and ordain this my last Will and Testament. First & principally, my body I recommend to the earth to be buried in a decent manner at the descretion of my executors herein named, & my soul I recommend to Almighty God, that gave it nothing doubting at the general resurection to receive the same again by the almight power of God. And as touching such worldly estate which it hath pleased Almighty God to bless me with in this life. I demere and dispose in the following manner & form. - Item. - I give to my beloved wife, ANN PEAVEY, the tract of land I now live on, with all my stock of all kinds, also all my plantation tools, household and kitchen furniture ???? during her natural life, and at her death to equally divided betwix all my children. Item - I give to my grandson WADE HAMPTON PEAVEY one sorrel filly, also one brindel heifer, to him and his heirs forever. Item - I give to my Daughter MARY PEAVEY one Bed to be given her by my wife, to her and her heirs forever. It is my wish and desire for my wife to sell the wagon & horses also the land, and any of the stock she may think proper, after paying my grandson WADE HAMPTON his legacy. And I do constitute and appoint my son ABRAHAM PEAVEY and my beloved wife ANN PEAVEY, Executors to this my last Will and Testament, ratifying this and no other to be my last Will and Testament, and also revoking all other former wills heretofore by me made. - In witness whereof I have herein to set my hand and seal, this 25th day of August, 1810.
