PROCEDURE/GUIDELINE RELATED TO EXPORT/IMPORT PERMIT FOR LIVE FISHES

Procedure/Guideline related to Export/Import permit for live fishes has 
been prepared by Jabatan Perikaan in the purpose of controlling the live 
fishes activity either inside or outside the country enforce under 
Pekeliling Cawangan Kawalselia 3/96.

The enforcement for the above regulations including Agenda/Procedure/
Export/Import of live fishes, Tiger prawn, Aquatic plants, Gropers and 
the exportation of fishes under fishery regulation (Import Prohibition 
and etc., for fish) 1996.


1. EXPORT OF LIVE FISH

1.1   The processes of the application for export of the live fish is 
      follow: 

1.2   Procedure:
     
      a) Applicant is reequired to register with Lembaga Kemajuan Perikanan 
         every year by completing threee (3) copies of the Application from 
         PEIA 1/95. 
     
      b) Application for the permit of the export of live fish in each 
         consignment shall furnish with the documents below:
         i)   Two (2) copies of invoices.
         ii)  Four (4) copies of Custom K2 form complete with such 
              information that is the normal name and scientific name of 
              the particular fish.
         iii) The Certificate of Health.

      c) Invoice shall contain the following specifications:
         i)   Letter head
         ii)  Invoice number
         iii) The general name and scientific name of the fish
         iv)  Quantity and value of the fish
         v)   Name and address of the importer
         vi)  To indicate number of package correctly
         vii) The official chop of the exporter

1.3   The Application for the export permit shall forward to the Fishery 
      Department at least three (3) working days in advance before the 
      date of export.

1.4   Each export permit is issued for one consignment only.

1.5   The export permit is only valid for forteen (14) days calculated 
      from the official date of issue. 

1.6   The examination centre for each consignment will be determined by 
      the Fishery Department in which a minimum of 10% of each consignment 
      will be checked.

1.7   The approval of the Borang Kastam (K2) will be issued to the exporters 
      after their consignments have been checked and sealed by the Fishery 
      Department.

1.8   Live Prawn
      1.8.1 Penaeus monodon, and Semisulcatus are not permited to export if 
            they are found to have lay eggs, or their length are more than 
            178mm (7 inches).
      1.8.2 Each package of the live prawn for export shall be examined by 
            the Fishery Department before it is allowed to export.

1.9   Blood Clam
      The Anadara granosa are not permitted to exportt if their lengths are 
      less than 31mm (1-1/4 inches).

1.10  Aquatic plant
      The export permit is issued by the Fishery Department, while the 
      santitation certificate as well as the phytosanitary certificate is 
      issued by the Agriculurtal Department.

1.11  Grouper
      The export of the grouper fry with the size of less than 7.8cm 
      (3 inches) are not permitted and takes effect from 1.1.96.

1.12  The export of fishes under The Fishery Regulation (Import Prohibition 
      and etc., for fish) 1990.

1.12.1  The export is required to obtain the permission to breed/keep/sell 
        from The Fishery Department.

1.12.2  Fishes are permitted to export on the condition that the export 
        permit is granted by the Headquater of the Fishery Department, 
        Kuala Lumpur. 

1.12.3  Before the fishes are being export the exporter shall have permit 
        for breeding/keeping/selling the fishes under The Fishery Regulations 
        (Import Prohibition and etc., for fish) 1990.

1.13  Fishes controlled under The CITES and listed by the Wild Life 
      Department.

1.13.1  A list of the fishes controlled under the CITES are stated below:

1.13.2  These fishes are permitted to export provided the followings 
        conditions are fulfilled:
        a) Haaving obtained the ceertificaate of origin from The Fishery 
           Department.
        b) Having obtained The CITES permit, the following conditions 
           must be fulfilled:
           i)  The fishes under CITES are the second generation or there 
               after and
           ii) The fishes concerned are produced in the form of 
               "Captive-breeding".
        c) Having obtained the export permit granted from The Fishery 
           Department. The procedure to apply for the export permitt is 
           stated in 1.2(a),(b),(c),1.3,1.4,1.5 and 1.7. 

1.13.3  For every consignment of the fishes under The CITES which intend 
        to export, the exporter shall forward his application to The Fishery 
        Research Institude (Institut Penyelidik Perikanan, IPP) to verify 
        the fishes concerned are produced in the form of Captive-breeding, 
        and are of F2 and its subsequent generation.
 
1.13.4  The Fishery Department will issue the CO through the IPP to the 
        exporter afterr the conditions of 1.13.3 are satisfied. A copy of 
        the CO shall be sent to the headquater of the The Fishery Department, 
        Kuala Lumpur for further action.

1.13.5  Every page of the CO concerned shall embossed with the seal of The 
        Fishery Dept. of Malaysia and shall be signed by the officer who 
        issued the CO.

1.13.6  The total fishes to be exported shall be indicated through both 
        numbering and wording in the CO.

1.13.7  Subsequently, the exporter should forward the CO while applying for 
        the CITES permit from the Wild Life Department.

1.13.8  In conjuction with the above, the exporter shall attach with the 
        original documents of the CO, CITES permit, invoice and the custom 
        K2 form in order to apply for the permit for exporting through the 
        headquater of The Fishery Department, K.L.

1.13.9  Upon obtaining approval from the headquater of The Fishery 
        Department, every consignment of the fishes will be examined by 
        the Fish Health Management and Quarantine (PPKIK) later or any 
        other plaus as specified by The Fishery Dept.

1.13.10 The consignment of the fishes will be examined by the Kawalsella 
        unit and Resources Control Branch unit, after which, a 
        certificate of health will be issued (if necessary) by the PPKIK 
        before it is permitted to export. 

1.13.11 The permit for export will be issued by the headquater of The 
        Fishery Department after each consignment has been examined and 
        found to have complied with the regulations.

1.13.12 The validity of the export permit shall not be longer than the 
        validity of the CITES permit.

1.14    The application for the certificate of Health (if necessary) 
        shall apply simulteneously with the application for the export 
        permit. This certificate will be issued after having examined 
        by the Fishery Department and found to have complied with the 
        relevant Regulations. 




2.  IMPORT OF LIVE FISH

2.1   The processes of the application for import of the live fish is 
      follow: 

2.2     a) All applicant is required to register every year by 
           completing three (3) copies of thee application form 
           PEIA 1/95.
        b) Application shall be furnished with the documents below:
           i)  Four (4) copies of Custom K1 form
           ii) Two (2) copies of invoice
        c) Invoice shall contain the following specifications:
           I)   Letterhead
           II)  Invoice number
           III) The general name and scientific name of the fish
           IV)  Quantity and value of the fish
           V)   Name and address of the importer
           VI)  To indicate the number of package correctly

2.3     Each permit is means for one consignment only and valid for 
        forteen (14) days from the date of thee permit for import 
        is issued.

2.4     For clearance of consignment, the certificate of health and 
        CO from importer's country shall produce to The Fishery 
        Department when the checking is conducted.

2.5     The permit for import will be issued after the examination 
        completed. A total of 10% of the consignment will be checked 
        in random.

2.6     For the import of fish under The CITES, the CITES permit 
        from both exporter's and importer's country shall attached 
        at the time of application.

2.7     Fishes prohibited under The Fishery Regulations (Restricted 
        for import, and ect. for fish) 1990, are not allowed to import 
        unless the written approval grantede by the Director of 
        Fishery Department of Malaysia.

2.8     Illness fishes are not alloweed to bring into Malaysia at all.

2.9     Any fishes suspect carry with disease will be quarantined. All 
        costs of management, treatment and disposal incurred shall be 
        born by importer.

2.10    The exotic fishes that never enter Malaysia before, a separate 
        application shall be made to Fishery Department in which the 
        consideration will be given on case to case basic.
