BEGINNING OF OUR NINTH YEAR.

This issue is the first number of our ninth year of publication. It was with some mis-givings at the time we began publication of this little leaflet. Never having been in that sort of business, and not knowing what the response would be, we were doubtful if our efforts would be appreciated and the results worthwhile, and so thought it very likely that a few issues would be all that we would publish and then forget it.

Thanks to all of you who have made it possible for us to have published it eight full years, and will continue to do so for an indefinite time. As we told you in the April number, we have not even scratched the surface as regards publishing what records we have, in this little leaflet. We doubt that we will live that long.

So we wish to thank each and every one of you who have helped to make it possible, and hope that in some manner we can compensate for the many favors that have come our way.

In our April issue we told you that we would finish with the John Darnaby family this month, and begin with that of his brother Edward. So beginning where we left off in the April issue we now continue.

WILL OF WILLIAM CLARK

I, William Clark, of Fayette County, and State of Kentucky, do hereby make and publish the following last Will and Testament, revoking all former wills made by me.

After the payment of my just debts and the expense of selling my estate, I devise and bequeath to my wife--Betsy Clark, the farm on which I now reside, situate in Fayette County, Kentucky, about four miles from Lexington on the Bryan's Station Road, containing two hundred and ninety (290) acres. Also all the stock necessary for carrying on the farm, farming utensils, house, kitchen and cupboard furniture; and at my death she shall hold the real estate during her natural life, and the other personal property absolutely, and whatever may remain of the personal property after her death to be equally divided between all my children.

After the death of my wife I devise and give to my two sons--James S, and George T. Clark, jointly, all my land in Fayette County, being the same that I gave to my wife. They are not to have possessin of said land until after the death of my wife. It is my desire that James and George shall live with their mother and manage for her.

I give to my daughter--Ann E. Wood, sixty acres (60 acres) in the tract which I gave her 185 acres indirect, the same to adjoin the land she has received.

And I further give to my sons--James and George, one hundred and twenty five acres, (125 acres) of land--my Bourbon farm adjoining Lowe's Station, after my death they are to have possession.

The sixty (60) acres I gave Ann E. Wood, she is to have possession after eighteen hundred and seventy one. (1871).

Should my estate receive anything from any sourse (sic) whatever, it is to be equally divided between all my children.

This May the twenty seventh, eighteen hundred and seventy. (May 27, 1870).

Sig--William Clark.

It appear from our records that neither James S, John William or George Thomas Clark, ever married.

WILL OF AMBROSE HALEY.

In the name of God, amen: I, Ambrose Haley, of the County of Fayette, and State of Kentucky, being of sound mind and memory, do declare this instrument of writing to be my last Will and Testament, revoking all others heretofore made by me.

First: It is my will that after my death my wife Mary Haley, have the farm on which I now live, including the appurtenances, it being the lot of land I first received from my father, together with the lot of land I purchased from my son William D. Haley, supposed to contain in all about 84 or 85 acres, during her life, and at her death to be divided between my children and grand children as my other land, in the manner hereinafter named.

Second: I also bequeath to my wife Mary Haley, the following slaves: Peggy and her two sons--Isom and Anthony; Ann, Harvey, Henry, Amanda and Jane, forever. And also the money I received from her father's estate--one part in cash and the balance loaned out, one hundred dollars in a note which I hold on James Darnaby; one hundred on Granville Smith; five hundred and fifty four dollars on James Carter; and six hundred and fifty nine dollars on John H. Darnaby; together with four hundred and ten dollars in cash on hand, forever. I also give unto her all my house and kitchen furniture, except that protion which will be hereinafter named. I also give unto her one third part of my horses and milk cows, such as she may prefer, and my bay mare-Red Bird, without charge, to be taken out at praise value, together with one third part of the remainder of my stock and crop; and in the event that she sould prefer one of the other hands on the farm instead of Harvey she shall have the right to take him instead of said Harvey.

Third: It is my wish that the balance of my estate

--8 (772)--

be equally divided between my children and grand daughter-Mary Elizabeth Darnaby, in the manner hereinafter named; to my son William D. Haley I have given two thousand dollars towards helping him to pay for the farm on which he now lives, and I wish the balance made equal with him out of my estate. It is also my wish that he should have my secretary extra, he being my only son. I have given to my daughter Lucinda Weathers eight hundred dollars in part toward making her equal to my son William D. Haley.

Fourth: It is my will that my daughter Mary Parish should have Susan and Mary Ann, two bed steads--one a fancy stead and the other a common one, together with the same quanity and quality of cupboard ware, as the balance of my children have received, to be given to her when she goes to house keeping.

Fifth: I bequeath unto my children-William D. Haley, Lucinda Weathers, Mary Parish, and my grand daughter Mary Elizabeth Weathers, the balance of my land, to them and their lawful heirs forever, to be divided among them by lot. Should my grand daughter Mary Elizabeth Weathers die before she becomes of age and leaving no lawful heirs, her portion shall descend to my surviving children or grand children as their several interest may be.

Sixth: It is my wish that my boy Hawkins be sold out of my estate and the money equally divided among the above named heirs. It is also my will that the balance of my slaves be equally divided amongst my children and grand daughter Mary Elizabeth Weathers. I request them to divide them amongst themselves, but in the event that it cannot be done, division to take place by sale.

Seventh: It is my will and desire that my son William D. Haley and my son-in-law William Weathers act as my executors to this my last Will and Testament, and I request that the court require no security as I have full confidence in them. In testimony of all and each of the above named items herein contained I have set my hand this seventeenth day of May, eighteen hundred and forty nine. (May 17, 1849).

Sig--Ambrose Haley.
