Will of Susannah Finer ( 1834 - 1903 )

I SUSANNAH FINER at present residing at the Sandringham Hotel Hastings in the county of Sussex spinster declare this to be my last will and testament I direct all my just debts funeral and testamentary expenses and all legacies bequeathed in any codicil or codicils to this my will to be paid by my executors hereinafter named I give to my sister Esther Finer all my jewels ornaments of the person and wearing apparel I give to the East Sussex Hastings and Saint Leonards Hospital the sum of fifty pounds free of

duty whereas I am possesed of or entitled to the following property one undivided moity or half part of a freehold messuage situate in and being No. 63 Leadenhall Street subject to certain annuities charged thereon and payable to my sisters Mary Owen Finer and Elizabeth Finer one undivided sixth share of and one fourth of another undivided one sixth share of certain freehold messuages and premises as situate in Leadenhall Street afore said and now known as Nos. 59, 60 and 86 Leadenhall Street and Hand and Pen Court which mesuages and premises are described in the Shedule to an Indenture of Conveyance between Thomas Owen Finer of the one part and Mary Owen Finer Emma Elizabeth Finer Esther Finer and Myself Susannah Finer of the other part and also one undivided sixth share of freehold Messuages situate in Redmans Row in the parish of Stepney in the county of Middlesex Now as to the said freehold property and all other my real estate and the residue of my personal estate I devise and bequeath the same as to two thirds parts thereof to my sister Esther Finer and George Edmund Waller of 75 Colman Street in the City of London Soliciter Upon trust as to one moity of such two third parts to receive the rents leases and profits arising therefrom and after payment thereout of al charges thereon and necessary outgoings to pay this same to my brother Thomas Owen Finer during his life for his absolute use and benefit and from after the decease of the said Thomas Owen Finer if he shall leave a widow him surviving then in trust for such widow during her life And from and after the decease of the survivor of them I devise and bequeath one third of my real and personal estate subject and charged as aforesaid unto my said trustees In trust for all the children or any the child of the said Thomas Owen Finer If more than one in equal shares and as to the other moity of such two thirds parts of my said real and personal estate Upon trust to receive the rents leases and profits aforesaid and after payment thereout of all charges and necessary outgoings to pay the same to my brother Frederick William Finer during his life for his absolute use and benefit and from after the decease of the said Frederick William Finer if he shall leave a widow him surviving then in trust for such widow during her life And from and after the decease of the survivor of them I devise and bequeath one third of my real and personal estate subject and charged as aforesaid unto my said trustees In trust for all the children or any the child of the said Frederick William Finer If more than one in equal shares And as to the remaining one third part of my real and personal estate I devise and bequeath the same subject and charges as aforesaid to my sister Esther Finer abolutely And I hereby authorize and empower the trustees or trustee for the time being of this my will at such time or times and in such manner as they or he may think fit to sell and convert into money all my real and personal estate or any part or parts thereof either by themselves of or for such purpose to join and concur with other persons beneficially interested in the property of which my share or shares may form part And I direct that the proceeds arising from such sale or sales shall be invested in the name of the said trustees or trustee in some or one of the modes of investment authorized by the act of the fifty second and fifty third Victoria Chapter thirty two or from time to time authorized for the investment of moneies under the control of the Court of Chancery And I declare that the income arizing from such investments shall be paid and applied to the same person or persons in the proportion and in the manner to whom and in which the income arising from my real and personal estate would for the time being be applicable if no such sale and conversion had been actually made And I declare that the said trustee and any other trustees or trustee to be appointed under this my will and my executors or executor may in their or his or her uncontrolled discretion instead of acting personally employ and pay a solicitor or any other person to transact any business or any set of whatever nature required to be done in the premises including the receipt and payment of money and that any trustee or executor of this my will being a solicitor or any other person engaged in any profession or business may be employed or act and shall be entitled to charge and be paid all professional and other charges for any business or act done by him or his firm in connection with the trust including acts which a trustee or executor could have done personally And I appoint the said Esther Finer and George Edmund Waller EXECUTRIX and EXECUTOR of this my will IN WITNESS whereof I have hereunto set my hand this fifth day of August one thousand nine hundred and three SUSANNAH FINER - signed and declared by the said testatrix as and for her last will and testment In the presence of us present at the same time who in her presence at her request and in the presence of each other have hereunto subscribed our names as witnesses
