I just got off the phone
with Errol Hohrein (10/2000) and he has
given me some very good news. The
Philadelphia law firm of Berger and
Montague has indicated a strong interest
in picking up on the dead class action
suit that Suzan Kawulok and 50-80 of us
had filed against Eli Lilly and
Novo/Nordisk on the matter of our
problems with human insulin.
Judge Berger has requested
that we have as many individuals as
possible Fax his office a detailed recap
of the problems each of us has
experienced with the “human” and
other synthetic insulins.
I would recommend that you
attempt to keep things to under 2-3
pages including your cover page and that
you provide the following information:

and Fax numbers

A
statement by you regarding the
specific brand(s) and type(s) of
synthetic insulins that you used
caused you problems and how the
removal of alternative insulins
from the US market continues to
harm you and your lifestyle.

sign on as a party to the
Kawulok v. Lilly and Novo
litigation in New Mexico Federal
Court.
The statute of limitations
may be running against many of us and
the legal problem of “laches” (the
legal position that equity aids the
vigilant and not those who slumber on
their rights, meaning that neglecting to
assert a right or claim over time may
bar the claim or eliminate the right)
may also be working against us.
I am hoping that at least
50 of us who have been severely harmed
by the use of synthetic insulins will
respond to this plea to give Judge
Berger the feel for what is happening to
us at the hands of Diabusiness.

A friend of ours,
working to find a replacement firm for the
firm in the Human/Animal insulin litigation,
ran across a firm looking to pick up on the
recently noted and adjudicated matter of
problems with Johnson & Johnson’s
Blood Glucose meters. I was asked to pass

interested or affected.
