Ref 3 August response from you as it relates to my belief you are now standing as a Greens candidate in the coming Gosford Council Elections.
Your vote in June 2002 to pursue all issues of defamation (If properly considering the Supreme Court decision in the matter of Ringland v Ballina Shire 1993 ) is a vote by Gosford councillors to actively involve themselves in improperly using the communities resources, pursuing an avenue not open to council. That is I believe activity which I can advise you, continues to be in breach of the Local Government Act. The duty of the General Manager has always been to do that which councillors have outlined in A. Did Mr Wilson need to be advised of his responcibility by the councillors? To get him to do his job? B. After eighteen months, has the matter moved closer to being finalised yet? Is Council attempting to cover-up its improper activity till after March 2004? I note the instrument falsifier Mr Grant Killen has now resigned from his Council position!
Your assertion that you don't understand what I'm talking about in my second question puts you in good company with past Mayor Councillor Brooks . Perhaps you were not advised as I was that the General Manager had instructed Mr Chris Gallagher to deal with my approaches personally. By taking over correspondence and responding to all my written complaints and inquiries to Gosford Council, Council Officers and Councillors. He advised me that this is intended to maintain a coordinated response. I feel that Mr Peter Wilson's directive is highly inappropriate! In fact interference with a constituents written approaches to his elected representatives could be considered censorship. I feel that any elected representatives who are unable or unwilling to respond to legitimate queries about their conduct as a public person, and concerns which relate to breaches of the crimes act, insurance irregularities, and other issues that by their very nature constitute corrupt conduct, should have long ago resigned from their civic responsibilities. Any assertion that I have defamed any person is nothing more than baseless allegations published in some cases by misguided and ill informed persons in the main politicians. I believe Councillor that I still have a democratic right to take my legitimate complaints about the incompetence and lack of due diligence of elected representative to the ballot box. If you have forgotten I'm sure Mayor Bell will be able to advise you what was said the night coward Gosford councillors found it entertaining to watch Mr James senior at 84 years of age attempt to defend his rights before the Corrupt Gosford Council, a council determined to give currency to falsified instruments, and other breaches of the relevant Acts.
The political consequence for councillors actions has a long time yet to run.

Ps. Have you really joined the NSW Greens Councillor Preece? Could you advise what the criteria is for pre selection? I understand the words long serving, and well known member have a place in the critera is that correct ?

The answer to the first question is yes.
I have no idea what you are talking about in the second.
People should not go around defaming others. If they have legitimate complaints, they should take them to the proper authorities. When I know I haven't a corrupt bone in my body and someone accuses me of such a thing, I know that others are likely to be in the same position. Mostly I just like to get on with the positive contribution I can make, and the difficult issues that I have to deal with as an elected representative and do it with all the integrity I know I possess.
I do not respond to everything you write because I like to spend my time as constructively as possible.

I am concerned that as one of our elected representatives you may be party to the perceived intimidation and conflicting advice directed toward me in written form by PJ Donnellan and Company, a law firm employed from time to time by Gosford Council.
Did you vote in favour of this three part item listed in the 25 June 2002 agenda
A If there is a breach of the law administered by council, the General Manager be authorised to commence procedings in the court.
B The confidencial report remain confidencial until the matter is finialised.
C The general manager take all necessaray actions to pursue all issues of defamation.
I and members of the community are also worried by information that as an elected representative you are unable to do your civic duty because criminal elements in Gosford Council hold sway, and that communications between constituents and councillors are interfered with at the direction of the General Manager. A matter for concern because the procedures for maladminastration complaints has been directly interfeared with creating a conflict with Gosford Council policy. Have you personally confided to constituents that you cannot conduct you duty without fear of consequences?
