Will of Reuben Henry

State of North Carolina, Anson county

I Reuben Henry, county above named, being of sound mind but considering the uncertainty of my earthly existence, do make and declare this my last will and testament in manner and form as follows:

I give and desire to my son HAMPTON HENRYexcept such parcels of said land as have been disposed of prior to this time. I give and desire to each of my children as follows: to E.M. HENRY, JULIUS A. HENRY, FURMAN D. HENRY, CORNELIA A. CARPENTER, DORA RUSHING AND JANE RUSHING, AND ELIZABETH BODENHEIMER, the tract of parcels of land laid off by me for them for which they now have titles to and their lawful heirs after them.

To my daughter, JANE M. CARTER, the parcel of land laid off for her on which I now live, including my dwelling house and out buildings provided that the foregoing lots of land shall be valued by disinterested parties and each party owning a lot valued higher than that of another shall pa over to such others until all shall have an equal part except the improvements put upon their lots, especially by E.M. HENRY and FURMAN D. HENRY shall not be taken into consideration in land valuation and provided further nothing herein contained shall deprive HAMPTON P. HENRY from securing his debts and of the land laid off for him after the divided lots have been disposed of as above my will and desire is that all my undivided land shall be equally be divided between all my lawful heirs. I give and bequeath to my granddaughter, ELLEN J. BIRD, twenty five dollars to be paid out of any of my estate, and , lastly, I do hereby constitute and appoint my son E.M. HENRY and my friends E.G. FLAGLER and B.F. CLARK, my lawful executors. To all intents and purposes to execute this my last will and testament in every part and clause thereof, according to the true interest and meaning of the same, hereby revoking and declaring all other wills and testaments heretofore made null. In witness whereof the said REUBEN HENRY do hereby set my hand and seal, the 8th day of April 1879, A.D.
