A third individual has entered the Recall McCain effort and they now seem to be organizing. One problem they face is the recall petition was filed starting the clock when they were not organized. It will take a HUGE volunteer effort to accomplish this task.

I, as President of F.A.C.T., think it is necessary to send a loud and clear message to Senator McCain that we have had enough and we wish to recall him.

I hope each and every one of you get involved in some way. If you don't have time, contribute money. If you don't have money, contribute time. If you have neither, spread the word to get somebody else to help. BUT DO SOMETHING!

The various recall drives have agreed to unite under this committee. The grounds for recall that will appear on the petitions are as follows:

"John McCain has become increasingly obsessed with avancing his own personal agenda contrary to President Bush, party leaders and rank and file Republicans. In his insatiable desire for massive national media attention, he has all but forgotten the people of Arizona who elected him. The last straw was his vote against final passage of President Bush's tax cut plan, the very center piece of George W. Bush's successful presidential campaign. John McCain's legislative judgment is no longer acceptable. He is continually sponsoring or cosponsoring legislatin that will weaken the civil liberties guaranteed by the U.S. Constitution."

Thank you for your continued encouragement, requests for petitions are coming in by the hundreds each day! The electronic file of the petitions and instructions will be available very soon. The committee is establishing an infrastructure of enthusiastic volunteers to coordinate the statewide petition drive kick off.

A headquarters office will be located in downtown Phoenix the phone number is 602-234-5757. We are loking for volunteer coordinators in all parts of the state and notaries. The petition forms must be notarized in the presence of the circulator before they are sent to the Recall Headquarters.

This page will be updated frequently in the coming weeks and months with information, evidence, activities and arguments supporting the efforts of the Committee to fulfill the guarantee of the U.S. Constitution that the great state of Arizona will have two Senators serving in the U.S. Senate.

The Committee feels strongly that this Senator has lost interest in serving his constituents and is now only serving himself. The state of Arizona lost full representation in the U.S. Senate when John McCain became interested in influencing the favor of potential voters in New Hampshire, Iowa and everywhere else as part of his presidential bid. The behavior during the presidential bid was excusable, the current behavior, however, is not. His vote against the recent tax cut, the campaign finance reform bill (which would probably make a site like this illegal) and unconstitutional gun control legislation are examples of his dereliction of duty as our senior Senator and violation of his oath of office. He would like to limit certain freedoms guaranteed in the Bill of Rights. The best way to get the money out of politics is to limit the amount of government money available to politicians' manipulation or to limit the terms of politicians. This committee believes the Senator has passed the limit.

Who is John McCain? What does he stand for? Perhaps he wants to be the next Republican Senator from Vermont. He appears to be uninterested in representing the people of Arizona. This recall activity, when successful, will end the speculation about John McCain's upcoming political future. When removed from office, no one will care about his party affiliation and the great state of Arizona will have full representation in the U.S. Senate by two committed Senators.

Some have argued that U.S. Senators are not subject to recall. Recall opponents give vague reason and reference to "Federal Elected Officials." Senators are clearly state elected officials that are selected to represent state interests on a federal level in state elections. State citizenship trumps federal citizenship. Only state citizens can be or vote for Senator. Federal citizens residing in other states can not vote for senators in states other than their own.

The attempts by states to enforce term limits have been argued as precedent against the recall of Senators. We disagree. The 17th amendment transfers the electoral power to the people from the state legislature for the selection of U.S. Senators. The recall is the exercise of the electoral power of Arizona citizens, the people not the legislature. In fact, the 17th Amendment goes on to describe the process on how to fill seats in the Senate when they become vacant. Read for yourself:

This line is intriguing: "twenty- five per centum of the number of votes cast at the last preceding general election for all of the candidates for the office held by such officer."

The last general election in 2000 dealt with Senator Kyl's U.S. Senate seat. There were about 1.4 million votes cast all of the candidates, which translates to about 350,000 signatures required for a recall. We believe that the "preceding general election" language refers to John McCain's office as he is the officer we are recalling. In his election held in 1998 about 975,000 people voted for the office of U.S. Senator in Arizona. That would mean about 244,000 signatures are required on the Recall John McCain petition. Title 19 of the A.R.S. contradicts Article 8 of the Arizona Constitution in how the number of petitioners is derived in this case. The AZ Constitution is the authority. A request from the Arizona Attorney General for interpretation on this issue is pending.
