I began dialog with Assistant Chief Spradling back in January of this year. Eight months later I see that Tempe has yet to comply with HB2095 which was passed well over a year ago. Too bad we weren't able to insert language into that bill which would hold municipal officials criminally liable for failure to comply.

Here is what Tempe must do to comply with the law.

1) In order for a request to check a gun to be a "reasonable request" the firearm must be stored on-site or very near on-site in the event of a complex of buildings.

2) Police ferrying peaceful citizen's firearms around is a waste of their time and should not be done.

3) The Tempe policy which requires guns which are held in the property room to go through NICS is not in keeping with the statute.

4) The Tempe ordinance which requires an individuals ammunition to be confiscated under such a check fails to comply with ARS 13-3108.

Another issue. Nothing in Title 13 requires Tempe to invoke the weapons checking policy. We see no need for it to be invoked in places which do not have specific, articulable security needs. A courthouse, yes. A library, no. A jail, yes. A park, no. A city council chamber, maybe. Perhaps just a very few buildings throughout Tempe would suffice. It would be lots cheaper. The Cities of Mesa and Glendale followed our lead on the parks, but for some reason decided to buy hundreds of dollars worth of lockers for places that had no armed security guards to take up the security slack caused by disarming the good guys. I am one of those good guys. Don't take my, or my wife's ability to defend ourselves away from us.
