CODE Micro Systems is so confident in the quality of our CODE Micro Systems PC products that we offer the original purchaser a 30-day money-back guarantee on all mail orders, subject to the following terms and conditions:

1. With your Customer ID number and Invoice number ready, contact your CODE Micro Systems representative. Customer Support. If we cannot resolve the issue to your satisfaction, we will provide an RMA (Return Merchandise Authorization) number and authorize the return of the CODE Micro Systems PC product.

2. Ship the CODE Micro Systems PC product to us with the RMA # on the label, freight prepaid and insured by you, using the original box and packing material (if available) and including any accessories, disks, cables, and manuals supplied with the CODE Micro Systems PC product. Write the RMA number in large, clear characters on the outside of each box you ship. CODE Micro Systems assumes no responsibility for equipment during shipment from the customer to our factory. Because the return process for different CODE Micro Systems PC products may vary, the Customer Support representative will inform you of any further details regarding the return of your CODE Micro Systems PC product.

3. Equipment must be in as-new, undamaged condition to receive credit. Software cannot be returned for credit except when the system is being returned; then, all software must be returned with the system.

4. To receive a refund, the CODE Micro Systems PC product must be received within 30 days from the date you received your CODE Micro Systems PC product. A copy of your packing slip establishing proof of purchase must accompany all returned CODE Micro Systems PC products.

5. Refunds for CODE Micro Systems PC products purchased with a credit card will be paid by issuing a credit on your card. Refunds for any other type of purchase will be made in the same manner as the purchase.

No shipping charges are refundable

CODE Micro Systems provides technical support for your CODE Micro Systems PC hardware product. Most hardware problems can be diagnosed over the phone, and, if necessary, a replacement part is quickly shipped to you or service is arranged. Limited technical support is provided for certain CODE Micro Systems purchased software applications. CODE Micro Systems does not, however, provide support for products purchased from third party vendors or software tutoring. Our technical support line operates Mon-Fri. 9am-6pm PST.

Three (3) Year Parts, One (1) Labor Only Limited Warranty

CODE Micro Systems warrants to the original purchaser that this CODE Micro Systems PC product, excluding items such as software and related documentation, will be free from defects in material and/or workmanship for three (3) Year Parts, One (1) Labor Limited Warranty from the date of delivery/pick-up. This excludes external peripherals such as printers, scanners, non-CODE Micro Systems monitors, CODE Micro Systems big screen PC monitors (including CODE Micro Systems Destination monitors), and portable system unit battery packs, which are covered for one (1) year. Software is excluded; however, defects in software media are covered for ninety (90) days. During the warranty period, CODE Micro Systems will correct any defects in material or workmanship, or any failure of the CODE Micro Systems PC product to conform to specifications, at no charge for in-house labor and materials. Shipping costs must be prepaid by the original purchaser. Any replacement part/product shall be new or serviceably used, and is warranted for the remainder of the original warranty or thirty (30) days from the date of shipment, whichever is longer. This warranty period is not extended as a result of purchasing any additional parts/products from us or upgrading your CODE Micro Systems computer. The original purchaser must promptly notify CODE Micro Systems in writing if there is a defect in material or workmanship. Written notice in all events must be received by CODE Micro Systems before expiration of the warranty period. This warranty is not transferable.

This Limited Warranty covers normal use. CODE Micro Systems does not warrant or cover:

- damage caused by failure to provide a suitable installation environment for the CODE Micro Systems PC product;

- damage during shipment other than original shipment to purchaser;

- damage caused by impact with other objects, dropping, falls, spilled liquids, or immersion in liquids;

- damage caused by a disaster such as fire, flood, wind, earthquake, or lightning;

- damage caused by unauthorized attachments, alterations, modifications or foreign objects;

- damage caused by peripherals;

- damage caused by the use of the CODE Micro Systems PC product for purposes other than those for which it was designed;

- damage from improper maintenance;

- damage caused by any other abuse, misuse, mishandling, or misapplication;

- consumable products;

- products purchased from third party vendors.

CODE Micro Systems and its suppliers’ liability for failure to repair the CODE Micro Systems PC product to conform to the warranty after a reasonable number of attempts will be limited to a replacement of the CODE Micro Systems PC product or, at CODE Micro Systems’s option, to a refund not to exceed the purchase price of the CODE Micro Systems PC product. These remedies are the Purchaser’s exclusive remedies for breach of warranty.

Under no circumstances shall CODE Micro Systems or its suppliers be liable for any special, incidental, or consequential damages based upon breach of warranty, breach of contract, negligence, strict liability, or any other legal theory. Such damages include, but are not limited to, loss of profits, loss of revenue, loss of data, loss of use of the CODE Micro Systems PC product or any associated equipment, cost of capital, cost of substitute or replacement equipment, facilities or services, down time, purchaser’s time, the claims of third parties, including customers, and injury to property.

DISCLAIMER OF WARRANTIES

THE WARRANTY STATED ABOVE IS THE ONLY WARRANTY APPLICABLE TO THIS PRODUCT. ALL OTHER WARRANTIES, EXPRESS OR IMPLIED (INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), ARE HEREBY DISCLAIMED. NO ORAL OR WRITTEN INFORMATION (INCLUDING BUT NOT LIMITED TO THE 30-DAY MONEY BACK GUARANTEE), OR ADVICE GIVEN BY CODE MICRO SYSTEMS, ITS AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF THIS WARRANTY.

Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This Warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

IN THE EVENT OF INCONSISTENCY BETWEEN ANY TERMS OF THIS CONTRACT AND ANY TRANSLATION THEREOF INTO ANOTHER LANGUAGE, THE ENGLISH LANGUAGE VERSION SHALL PREVAIL.

THIS DISCLAIMER OF WARRANTIES AND LIMITED WARRANTY ARE GOVERNED BY THE LAWS OF THE STATE OF CALIFORNIA.

Obtaining Warranty Service

To obtain service under this warranty, contact CODE Micro Systems Technical Support. If your issue cannot be resolved over the phone, the technician will either authorize the issuing of a replacement part/product or authorize the return of the CODE Micro Systems PC product for repair. Refer to the Parts Only Limited Warranty section of this document for your specific rights and responsibilities.
