Will and Testament of Lady Amelia Cust

This is the last Will and Testament of me Lady Amelia Cust of Belton in the County of Lincoln, Spinster.

I bequeath unto the Reverend Arthur Percival Cust of Reading in the County of Berks, Clerk, the sum of one hundred pounds sterling money for his own absolute use and benefit. I bequeath unto Alice Amelia Jones, the daughter of Charles and Alice Jones, now residing at No. 123 Mount Street, Grosvenor Square in the County of Middlesex, the sum of five hundred pounds sterling for her own absolute use and benefit, such legacy of five hundred pounds to be absolutely vested in her, the said Alice Amelia Jones, on my decease and, in the event of the said Alice Amelia Jones departing this life in my life time, then I bequeath the aforesaid sum of five hundred pounds unto the person or persons who at my decease shall be next of kin of the said Alice Amelia Jones and who, under the Statutes of the Distribution of Intestates Effects, would be entitled to the said Alice Amelia Jones's personal estate if she were dead Intestate and a Spinster, such persons if more than one to take the said sum of five hundred pounds on the happening of the event aforesaid in the proportions prescribed by the Statutes. I bequeath to the aforesaid Reverend Arthur Perceval Cust, as the trustee and executor of this my Will, the sum of three thousand pounds, upon trust, to invest the same in his name in or on the Public funds of the United Kingdom and to pay the annual income thereof to Alice Jones, the wife of Charles Jones, now residing at No. 123 Mount Street, Berkeley Square in the County of Middlesex, during her life but so that,during her present or any future coverture, my aforesaid trustee and executor shall pay the same annual income thereof to Alice Jones during her life, as the portions thereof shall accrue, out and not by way of anticipation into her proper hands and for her sole use, free from marital control, and for which payments her receipts shall be discharges to my said trustee and executor or trustee for the time being of this my Will and, after the decease of the aforesaid Alice Jones, upon further trust for my said trustee and executor, his executors, administrators or assigns, or the trustee for the time being of this my Will to transfer, assign or pay over the aforesaid principal fund arising from the aforesaid sum of three thousand pounds unto Katherine Anne, Viscountess Cranley (b. 18 Nov 1822, d. 18 Oct 1885, 4th daughter of John, 1st Earl Brownlow and next younger sister of Lady Amelia Cust, widow of Arthur George, Viscount Cranley, b. 16 June 1820, d. 2 Aug 1856), lately of Bournemouth, Dorsetshire, her executors, administrators or assigns for her own absolute use and benefit and I empower my said trustee and executor, his executors, administrators and assigns, during the life time of the said Alice Jones, with the consent in writing of the said Alice Jones and Katherine Anne, Viscountess Cranley, if living or if dead, with the consent of her executors, administrators or assigns in the discretion of the Reverend Arthur Perceval Cust, his executors, administrators or assigns, or the trustee for the time being for this my Will, to change from time to time the investment of the said sum of three thousand pounds from any of the said funds or services to any other or others of the like nature. And I give, devise and bequeath unto the aforesaid Katherine Anne, Viscountess Cranley, her executors, administrators and assigns, all and singular, the lands, tenements and real estate, and all the various of my goods, chattels and personal estate and effects whatsoever and wheresoever of, in or to which I may or shall at the time of my decease be seized, possessed, interested or in any wise entitled either in possession, reversion, remainder or expectancy or otherwise howsoever and all my estate and interest therein and also all hereditaments and real estate and residuary goods, chattels and personal estate, whatsoever and wheresoever, over which I have or may have any power of appointment or disposition whatsoever to hold the same and every part thereof unto and to use of the said Katherine Anne, Viscountess Cranley, her heirs, executors, administrators and assigns, respectively, allowing to the respective natures and qualities thereof for her and their own absolute use and benefit. I declare that, if my trustee, herein named, shall die in my life time or if he or any trustee to be appointed under this Clause shall, after my death, die or be unwilling, incompetent or unfit to accept or execute the trusts of my Will or desire to retire from the office, it shall be lawful for the said Katherine Anne, Viscountess Cranley, whether covert or sole, and after her death for the trustee for the time being, if any, of my Will, whether retiring from the office of trustee or not, or if none for the proving executors or executor for the time being or for the administrators or administrator for the time being of the last deceased trustee to substitute by any writing under her, their or his hands or hand any person to be trustee in the place of the person dying, whether in my life time or afterwards, or refusing or being incompetent or unfit to act or desiring to retire from the office and I exempt every executor and trustee of my Will from liability for losses occurring without his wilful default and authorize him to retain all expenses incidental to the office of executor and trustee. I appoint the Reverend Arthur Perceval Cust to be trustee and Executor of this my Will. Lastly, I revoke all other wills and witness whereof I have hereunder set my hand and I have also set my hand to each of the two preceding sheets of this my Will this twenty second day of June in the year of our Lord one thousand eight hundred and sixty three - Amelia Cust - signed by the said testatrix Lady Amelia Cust as and for her last Will and Testament in the presence of us present at the same time who, at her request, in her sight and presence, and in the presence of each other, have subscribed our names as attesting witnesses - William Gilliam Slack of No. 91 Mount Street Grosvenor Square - Henry Taylor of the same place Clerk to Mr. W.G. Slack.

This is a Codicil to the last Will and Testament of me the Right Honorable Lady Amelia Cust of Belton in the County of Lincoln, Spinster. Which said Will bears date the twenty second day of June one thousand eight hundred and sixty three.

I give and bequeath unto Henry Jones of Cambridge Street, Pimlico, in the County of Middlesex, the sum of five thousand pounds sterling upon the trusts herein after mentioned and I direct the executor of my said Will or my legal personal representative for the time being to pay over or to transfer to the said Henry Jones the said sum of five thousand pounds sterling as soon as conveniently may be after my decease. And I declare that the receipt of the said Henry Jones for the same shall be a valid discharge to my said executor or person paying or transferring the same. And I further declare that the said Henry Jones, his executors, administrators, shall stand possessed of the said sum of five thousand pounds upon trust to invest the same in the name or under the legal control of him, the said Henry Jones, in the Public stocks or funds or Government securities of the United Kingdom or in such other securities in or upon which trustees are or may from time to time be permitted by Statute or by the practice of the Court of Chancery to invest trust property with power to vary such stocks, funds or securities during the life of Alice Jones, wife of Charles Jones, now residing at Grosvenor Villa, Belsize Road, Kilburn, with her consent in writing, and, after her decease, at his or their discretion and upon further trust to pay the income of the said trust promises to the said Alice Jones during the term of her natural life, for her sole and separate use, and, so that she shall have no power in any way to anticipate the same income, her receipt to be a sufficient discharge to the said trustee for the same. And, after the death of the said Alice Jones, shall hold the same sum of five thousand pounds sterling, or the stocks, funds or securities in or upon which the same may, for the time being, be invested upon trust for all the children or any, the child of the said Alice Jones, whether born at the time of my decease or afterwards, if more than one, equally to be divided between them, share and share alike, as tenants in common and if but one then the whole to such one child provided that the said trustee may, after the death of the said Alice Jones, or in her life time with her consent in writing, raise any part or parts of the then expected, presumptive or vested share of any child of the said Alice Jones, under the trusts herein declared ,and apply the same for his or her advancement or benefit . And I hereby declare that if the said Alice Jones shall die without leaving any child or children who shall acquire a vested interested under the trust herein declared then the said trustee shall hold the said sum of five thousand pounds and the stocks, funds and securities in or upon which the same may for the time being be invested and the income thereof in trust for the said Alice Jones , her executors and administrators.

I also give and bequeath unto the said Alice Jones the legacy or sum of two hundred pounds sterling for her own use absolutely and I declare that the bequests herein contained in favor of the said Alice Jones and her child or children shall be in addition to all other bequests or benefits bequeathed to them or either of them by my said Will and that the same shall be paid free of legacy duty and also that all bequests by this Codicil given to any females shall be for their sole and separate use, independent of the debts, control or engagements of any husband. And I hereby further declare that if the said Henry Jones shall die in my life time or if he or any trustee or trustees to be appointed in respect to the trusts by this Codicil created as herein after provided shall, after my death, die or be discharged or refuse or become incapable to execute the trusts of this Codicil or desire to retire from the office, it shall be lawful for the said Alice Jones, whether covert or sole, and after her death for the trustee for the time being for the said trust promises, whether retiring from the office of such trustee or not, or if none of such trustee or not, or if none for the proving executor or executors for the time being, or for the administrator or administrators for the time being of the last deceased trustee to substitute, by any writing under her, their or his hands or hand, any person to be a trustee in the place of the person so dying, whether in my life time or afterwards, or refusing or being incompetent or unfit to act or desiring to retire from the office. And, after the death of the said Alice Jones, shall hold the same sum of five thousand pounds sterling, or the stocks, funds or securities in or upon which the same may, for the time being, be invested upon trust for all the children or any, the child of the said Alice Jones, whether born at the time of my decease or afterwards, if more than one, equally to be divided between them, share and share alike, as tenants in common and if but one then the whole to such one child provided that the said trustee may, after the death of the said Alice Jones, or in her life time with her consent in writing, raise any part or parts of the then expected, presumptive or vested share of any child of the said Alice Jones, under the trusts herein declared ,and apply the same for his or her advancement or benefit . And I hereby declare that if the said Alice Jones shall die without leaving any child or children who shall acquire a vested interested under the trust herein declared then the said trustee shall hold the said sum of five thousand pounds and the stocks, funds and securities in or upon which the same may for the time being be invested and the income thereof in trust for the said Alice Jones , her executors and administrators.

I also give and bequeath unto the said Alice Jones the legacy or sum of two hundred pounds sterling for her own use absolutely and I declare that the bequests herein contained in favor of the said Alice Jones and her child or children shall be in addition to all other bequests or benefits bequeathed to them or either of them by my said Will and that the same shall be paid free of legacy duty and also that all bequests by this Codicil given to any females shall be for their sole and separate use, independent of the debts, control or engagements of any husband. And I hereby further declare that if the said Henry Jones shall die in my life time or if he or any trustee or trustees to be appointed in respect to the trusts by this Codicil created as herein after provided shall, after my death, die or be discharged or refuse or become incapable to execute the trusts of this Codicil or desire to retire from the office, it shall be lawful for the said Alice Jones, whether covert or sole, and after her death for the trustee for the time being for the said trust promises, whether retiring from the office of such trustee or not, or if none of such trustee or not, or if none for the proving executor or executors for the time being, or for the administrator or administrators for the time being of the last deceased trustee to substitute, by any writing under her, their or his hands or hand, any person to be a trustee in the place of the person so dying, whether in my life time or afterwards, or refusing or being incompetent or unfit to act or desiring to retire from the office.

In witness whereof I have to this Codicil set my hand this fifteenth day of August one thousand eight hundred and sixty six - Amelia Cust - signed by the said testatrix the Right Honorable Lady Amelia Cust as and for a Codicil to her last Will and Testament in the presence of us present at the same time who, in her presence, at her request and in the presence of oath, other have hereunto subscribed our names as witnesses - Edmd. Proved at London with a Codicil 28th Novr. 1870 by the oath of the Revd. Arthur Perceval Purey Cust, heretofore the Revd. Arthur Perceval in the appointment written "Percival", Cust, Clerk, the sole executor to whom Admin was granted.
