REGENT HOLIDAYS AND WEB SITE
Dear Mr. & Mrs. Morris:
It has been brought to my clients attention that a web site has been created by yourselves. While my client has no objection to any person or party creating a web site, it strongly objects to a web site which disparages its reputation.
My client has carried out an extensive review of the information contained in the site and postings made by yourselves. Copies of the same have been printed out for review.
As you are aware, the law of defamation is designed to ensure that one will be in possession of a reputation which is unimpaired and that one is able to retain one's good name.
Reputation depends upon opinion and opinion is based upon the communication of thought and information from one man to another. If a person communicates information to the mind of another which is untrue, in the natural course of events, this will disparage the reputation of the party in question; and a party who has communicated the said information is guilty of a legal wrong, which may give rise a law suit based upon the action of defamation.
As I indicated at the outset, while, my client believes in freedom of speech, it will not stand by and permit any party to engage in defamation. My client is prepared to give you until the 20th of July to correct the inaccuracies found within your web site. If this not occured by the 20th of July, my client will pursue its legal remedies in this matter with vigour.
If you have any questions, please contact the undersigned.
Sincerely yours,
Catharine M. Buie
Legal advice tells us that by publishing reports by anyone other than ourselves, we could be held accountable for defamation.
