Will of Benjamin Goldsmith

    In the name of God Amen, I Benjamin Goldsmith of Goshen in the county of Orange in the province of New York being weak in body but of sound and disposing mind and understanding do make and publish this my last Will and Testament in manner following to wit.

     I give devise and bequeath to my loving wife Jemima a negro girl called Lety and to my daughter Mary one negro girl called Betty to have and to hold the said negro girls to them respectively and to their respective heirs and assigns forever.
     Item:  I give devise and bequeath to my said wife Jemima one equal third part of all my personal estate and all the rest and residue of my estate wheresover and whatsoever.

     I give devise and bequeath to my executors herein after named to sell and dispose off at public vandue or otherwise and the monies arising therefrom to divide and pay to my wife and to my children, James, Mary, Benjamin, Daniel and John, share and share alike and I do hereby fully authorize and impower my said executors make seal and execute a deed or deeds for the same.

     Also I do direct and my will and request that my said executors to take charge of my said children and educate and bring them up and when they respectively arrive to the age of twenty one years to pay to them their said shares after deducting the expences of maintaining and educating them also I direct and my will is that my negroes that are directed to be sold may be allowed the choice of a master.

     And lastly I do nominate, constitute, and appoint my father Richard Goldsmith, my brother Richard Goldsmith, and Bimuel Youngs all of Orange county to be executors of this my last will and testament hereby revocking and disanulling or other will or wills by me heretofore executed and declare this only to be and contain my last will and testament. In testamony wherof I have hereunto set my hand and seal at New York this nineteenth day of October anno Domini 1777, Benjamin Goldsmith, Signed Sealed Published and Declared by the testator as and for his last will and testament in the presence of us who subscribed our names as witnesses therto in his presence and in the presence of each other and at his request.
