Professor Ghulam Azam

The supreme court of Bangladesh gave the verdict that Professor Ghulam Azam is the citizen of Bangladesh.Thus his citizenship has been restored. For the restoration of his citizenship he had to wait 21 years.Through a notice in 18th April'1973 the then Awami League government declared that Professor Ghulam Azam with 38 other persons is disqualified for citizenship. Prof. Azam at that time had been staying at Mecca and performing the Hajj.

He could not return back to Bangladesh after the liberation war of 1971 and had to stay out side the country for ling time. In July 1978 he returned to his country with a Pakistani Passport ( he had to use that as travel documents under the cfompelling situation). He had surrendered his Pakistani Passport to the government and applied for the citizenship. But till 1992 no government took the matter seriously.Time to time some notice were issued to him saying how he has been staying in the country without Visa. And in the national assembly discussion on Ghulam Azam came several times.

On the 24th of March'1992 he was arrested by a local thana police under the foreigner's Act. Jamaat and Chatra Shibir leaders and workers along with thousands of people lay poratrate on the streets and started sobbing on chorus.Ghulam Azam delivered his speech to the crowd.

The citizenship issue of prof. Azam then reach into the court area. In the high court division Bench of Supreme Court the verdict came 1:1. Justice Ismail Uddin Sarkar rejected the petition for citizenship. Justice Badrul Islam Chowdhury upheld that Prof. Ghulam Azam was a citizen of Bangladesh by birth and by the operation of law. He was a citizen on March 26'1971. He said that the government notification dated april18,1973 cannot be operative retrospective because in the exercise of the government's delegated power retrospective effect cannot be given to any of i's order unless specifically empowered by law. Ghulam Azam had the right to exercise his franchise and stay in Bangladesh. The case then had been referred to the chief Justice of the supreme court for hearing. As per constitutional provision Chief Justice formed a seperate bench to hear the case. The supreme verdict was totally infavor of Prof. Azam.

Professor Azam's lawyer Barrister A.R yousuf is one of the senior Advocates of the Appealate division of the supreme court. He passed the M.A LLb from the Dhaka University and was admitted as barrister in the Lincoln's Inn U.K on Feb'9'1965. He joined the high court in July 2,1965. About the case of Professor Azam Barrister Yousuf remarks that he appeared for a pious and respectable leader and an innocent person who was fighting relentlessly for a cause. Barrister is from Akhaura, Comilla.
