ALABAMA'S NEW DUI LAW as of May 1998
A person cannot drive or be
in actual control of any motor vehicle while there is a 0.08 percent or more by weight of
alcohol in his or her blood.
Upon a first conviction for DUI a person shall be punished by paying a
fine of $600-$2,100, up to 1year in jail and *his or her license will be suspended for 90
days.
Upon a second conviction for DUI a person shall be punished by
paying a fine of $1,100-$5,100 and may be imprisoned from 48 hrs or 20 days community
service up to 1 year and *his or her driver's license will be revoked for a period of 1
year.
Upon a third conviction for DUI a person shall be punished by a
fine of $2,100-$10,100,imprisonment from 60 days to 1 year and *his or her driver's
license will be revoked for a period of 3 years.
Upon a fourth or subsequent conviction for DUI , a person shall be
punished by a fine $4,100 - $10,100 and by imprisonment from 1 year to 10 years. A fourth
or subsequent conviction will be considered a Class C felony and a *person's driver's
license will be revoked for a period of 5 years.
First DUI under age
21--(with a blood alcohol level of .02-.08) is a fine of up to $250 (if under age 19), and
*his or her driver's license will be revoked for a period of 30 days.
Second DUI under age
21--(with a blood alcohol level of .02-.08) is a fine of $1,100-$5,100, imprisonment from
48 hours or 20 days of community service up to 1 year, and *his or her license will be
revoked for a period of 1 year.
* Driving under the influence
of a controlled substance or under the combination of alcohol and a controlled substance
will result in an additional 6 month license suspension. |
