Setting the scene - On the morning of Abby's trail, Ben comes to the carriage house to see Ross and Blake (Ross has told Blake that Ben is his brother)
Doorbell rings, Ross opens the door to Ben
Ben - (taking it upon himself to enter!) Good morning brother. Blake- pastries, fresh from the oven, the hotel concierge told me it was the best bakery in Springfield - Cherry Cheese is their big seller

Blake - Oh Ben, an attorney of your calliber certainly shouldn't waste his time on a case like this, especailly one so cut and dried
Ben - And what makes you think it is?
Blake - Well take a look at your client, Roy Meecham, I mean this man committed an unforgivable act of violence against an innocent woman, he deserves to pay for what he did
Ben - You make a compelling arguement Blake
Blake - Well I leave all the legal-eagling to my husband, but I'm telling you, if you go up against the DA on this case and your sure to lose Mr Warren
Ben - Are you your husbands press agent? - No, but I used to be in the business
Ben - Ahhh, that must be why your so good at it
Blake - Well a man like my husband doesn't need PR, I mean Ross happens to be one of the most respected and admired attorneys in the state. Now even if you were to win this case, which I really don't think you could, there would still be this bad blood between the two of you, in the name of family, couldn't you just put this aside?

Ross goes towards Ben

Ross - Nothing I say means anything to you, and coming on to my daughter and propositioning my wife that's just payback, that's revenge, but I'm not going to take the bait. Setting the scene - After the trial, Ben is at the Towers - Rick comes over to him, very angry!
Ben - Doctor Bauer - would you like a spritz?
Rick - I'm not here for a damn social visit - I'm here to inform you that I'm bringing you up on criminal charges
Ben - Oh really? Such as what?
Rick - Obstruction of justice, tampering with a witness just to name two
Ben - Those are serious allegations
Rick - Terri Clark came by to visit Abby, she told us that Roy Meecham brutalized her, just like he brutalizzed Abby, but you knew that didn't you - except that Terri was raped
Ben - Well the name rings a bell but I
Rick - Spare me the ficamimic crap, and I'd wipe that smug look of my face if I were you, Terri's ready to come forward now, no thanks to you and what ever you said to her before the trial - she's ready to testify and she's ready to do it right now Benie
Ben - Well I thought your finacee was copping a plea bargin
Rick - Abby is not going to be anybody's damn sacraficiale lamb, not after finding out that Roy was busy violating other women, you see, Terri's story convinced Abby to fight
Ben - Really?
Rick - That's right. Terri's testimony would have been crucial evidence in the case against Roy, but somehow the prosecution never got a hold of it, did they?

Ben - It was the judge who set Roy free, all I did was present my case
Rick - You manipulated that woman from telling the truth - what kind of man are you?
Ben - I'm a lawyer, the kind of lawyer who knows how to win at all costs, a much better lawyer then the lawyer who prosecuted the case, and exactly the kind of lawyer that Abigail needs right now

Rick - I would rather eat ground glass then have you represtent Abby
Ben - Then you might be eating it while visiting your finacee on death row my friend. An entire courtroom full of people saw her shoot Roy Meecham in cold blood
Rick - No jury in their right minds would convict Abby
Ben - That what Ross told you? But then Ross had Abigail convinced to accept the plea bargin didn't he? Let me give you a little piece of advice, free of charge - be very careful what counsellor to take from my brother, you see he's the one who let Roy walk, because either he didn't see my defense coming or he simply didn't have an answer for it
Rick - Ben, you need new material
Rick starts to leave
Ben - Dr Bauer, you don't have to like me to hire me. My last client, the slime bucket you called him, I got him off
Rick - Yeah, and your proud of that aren't you?
Ben - I did what I was suppose to do - I did whatever it took, I did my job. But you don't want to hear the dirty little realities do you? You want to trust in God, in the innate goodness of man, that's fine - I hope it keeps you warm at night
Rick - This is just a game to you isn't it? You don't give a damn about Abby you know, you just want to go round two with Ross
Ben - What's the difference - as long as I win and Abigail goes free - isn't that the only thing that matters?

Ben - I want to take this case because I know I can get Abigail off. If I said that I feel responsible for what happened to her would you beleive it?
Rick - No, because you don't know the meaning of the word guilt Ben
Ben - Well as I said the only that matters is that I have the tools to get the job done
Rick - Is that so ?
Ben - This isn't a popularity contest Rick. This isn't about whether or not your going to invite me over to your house for fondoo, it's about winning
Rick - At all cost, right?
Ben - Like I said, you don't have to like me
Rick - Oh that's the easy part, beleive me
Ben - You know, the judge in Roy's hated my guts, she said she thought Roy should go to jail, but she had to let him go free, just as the next judge will have to let Abby go free - If I'm representing her, because I'm good at what I do. Now your going to have to ask yourself what it is you really want here, and what your willing to do to make that happen
Rick gets up to leave
Rick - I want her free
Ben - Good. Good
Rick is almost out the door - Blake has been watching them
Blake - Rick, I saw you talking to Ben Warren - what were you doing talking to that poor excuse for a human being?
Rick - No offense Blake but it's none of your business
Blake goes over to Ben
Blake - Why don't you just go and crawl back under your rock and leave decent people like Rick and Abigail alone
Ben - And it's good to see you again too Blake
Blake - I want to know what you were talking to Rick about

Blake - How dare you use my children to get back at Ross
Ben - I have no idea what your talking about
Blake - Oh no? Why don't you tell me what that little chat with Rick was all about
Ben - Dr Bauer was telling me that his financee has decided to stand trial for murder, so I imagine the last thing on his mind is going to be getting custody of his little boy - unless, Abigail's convicted, sent to prison, I think Rick will probably be lonely, he'll probably want his little boy around the house to help fill up the void. You better hope that Rick hires Abigail a damn good lawyer
Blake - What are you saying?
Ben - Oh Rick Bauer and I started off on the wrong foot I think, but I'm beginning to think that Rick is an okay guy
Blake - Why are you doing this? I mean really - why are you so intent on crucifying Ross?
Ben - I thought you knew that Blake
Blake - How many times does he have to apologise for not telling you who your mother was? How long are you going to hold this grudge?
Ben - Grudge? Ross took my life away from me, I just want to take his away from him

Ross - Don't you want to find out about this life that you think you've missed? Ben, just drop the attitude - come over here and look at this

Ross - She was even prettier then that, this was taken before her eyes started to reflect nothing but sadness
Ben - Yeah well, you had a chance to see that didn't you, and you never gave me that chance
Ross - I got no satisfaction from keeping the truth from you - I wanted to tell you that you were my brother, when you came back and asked about your mother, I wrestled long and hard about what to do
Ben - Yeah and I guess we know who won don't we
Ross - You think you know why I did it, but you don't

Ross - Our mother had a very strict upbringing, she beleived that a woman had her place and all the men in her life, all the men re-enforced that, she beleived that a good woman just didn't make waves, when my Dad died I was too young to understand how devestated she was, it was years before I undertood what appearences meant to that woman. She worked hard Ben, all the time, with little reward and when she wanted the company and comfort of a man she worked equally hard to hide that from me because of her upbringing she was ashamed of these needs and she was devestated needless to say when she became pregnant with you
Ben - Needless to say
Ross - I vowed to protect her from any more pain and when you came around I wanted to protect her from her memory of this proceived shame, and by then she was sick, I was afraid that meeting you would make her last days agony Ben, I was acting out of love
Ben - And after she died you still didn't tell me the truth - are you going to tell me you were acting out of love then as well?

Ross - What is it you want?
Ben - Something you can't give me
Ross - Ben I'm sorry, I am sorry that I kept the truth from you - but it was between hurting you and hurting my mother and she was a sick old woman, Ben it would probably would have been worse if you had met her because she would've turned away, she would have been in denial, she wouldn't have accepted anything
Ben - Yes but we will never know that will we? Because you decided to play God - with my life and with hers
Ross - No, I wasn't, I was trying to do the best I could in a very difficult situation and yes, maybe I made a mistake but I was not trying to hurt you I was trying to protect my mother. And for her sake, God rest her sole, maybe we should start acting like brothers
Ben - And what is that like? Tell me
Ross - Ben, I don't know, we would have to work that out together
Ben - Hmm, so your going to waltz me around, introduce me to the folks, call up Justin and Lanie, tell them they've got a baby brother
Ross - I don't know, whatever it is that you want to do, we would do what families do
Ben - Yeah, but I don't know what that is Ross. So your just going to welcome me into your heart and home, is that it?
Ross - That would be better then having you destroy it
Blake comes in with the boys/talks to Ross
Blake - Ben
Ross - Ben and I had some things to work out
Ben - Ross was just saying we could be family
Ross picks up Kevin
Ben - That's Kevin, isn't it?
Ross - Yes
Ben - Hey, Kevin, Kevin - what to play ball with Uncle Ben, huh?
Ross - Ben and I were trying to take a first step towards something, hoping that things will change
Blake - Your wrong Ross, nothing's changed

Ross - So everything I said to you - it didn't mean anything?
Ben - Oh you got alot off your chest (Blake gives Kevin back to Ross), your about to get something on your chest, but Blake is right, it doesn't change anything
Ross - So you would rather argue with me? You would rather fight me, rather then change anything, try to be a family in any way
Ben - Because you took away my real family Ross. I'm like Kevin here, caught between two daddies in limbo
Ross - No, he's my son
Ben - Oh your good Ross, very creative, very innovative and you got rid of me once before with your money, college tuition, fancy job, but I've learned my lesson, a few sad stories and old photo's isn't going to get rid of me this time

Ben opens door after seeing who it is...
Ben - Hello. (contiues to talk into tape recorder) I think Marshell wrote an opinion on it, and fax the supreme court, we need access to the archieves (clicks tape off)
Blake - Your so thrilled with your own self-importance it's like a political cartoon
Ben - Oh sexy and funny - that's kind of an irresistable combination don't you think?
Blake - Pompous and slimy - how irresistable is that

Blake walks into the room

Blake - Well Christmas is just going to have to wait for you pal, because Ross' resignation as DA has been accepted, and Abby has hired him to defend her so you can just pack up your designer bags and hit the road
Ben - And I thought I'd gotten through to your old boyfriend there, Rick
Blake - He was never my boyfriend, and it was Abby's decision - she hired Ross, in fact I do beleive she is sitting in our living room even as we speak
Ben - Wrong lawyer, that's a big mistake
Blake - You made the mistake counsellor, coming here and acting so dispicably to my family and to Ross
Ben - I acted dispicably to Ross???
Blake - He explained why he did what he did, he even apologised to you
Ben - How? By taking me down memory lane, those memories should have been mine
Blake - Go away Ben
Ben - I'm not going anyway Blake and I'm not through with Ross, I'm just getting started here
Blake - You know, I could almost feel sorry for you, you've lost touch with reality you really need to get a grip
Ben - It's that an offer?

Ben - Why not? It's a pretty town, people are civil, the women are beautiful - unpredictable, seen a couple of nice restarants, in fact isn' t there a for sale sign on the house across the street from you?
Blake - It already has it's fill of termites. No Ben really, there's nothing for you here, nothing that would interest a big hotshot like you
Ben - Oh you'd be suprised at what interests me, my friend... My nephews for instance, maybe I should stick around and watch them grow up, toss a football with them on crisp autumn afternoons, we could be like the Kennedy's hanging out on Sunday's, everyone sitting down to dinner, the table creaking with home cookiing, the adults discussing the week's events, the kiddies laughing gaily as they play - I can see it all now, the Marler clan
Blake - How about the solo Warren clan - sitting in his New York apartment heating up his tv dinners
Ben - Hardly. But you know, you look like a gambling woman to me. I'll tell you what, I'll make you a bet, if Ross wins I'll leave Springfield forever - but if he doesn't win and I have something to do with it then you sleep with me
Blake - What???
Ben - Why not? I don't drop good ideas easily. What do you say?

Ben - I'll take that as a yes, we have a bet
Blake - I don't know what your talking about. First of all, how are you going to be responsible for Ross losing - really, I mean Abby chose him to represent her, she did not chose you and then there's nobody in the DA's office who can touch Ross as a lawyer so the case is in the bag
Ben - And I took you for a gambling woman. You gambled with the secret of your son's paternity, but you lost that one didn't you?
Blake - I lost nothing, I have my twins
Ben - So your not at all sure your husband can pull this off are you?
Blake - Oh that's just absolutely ridiculous
Ben - So take the bet and prove it's ridiculous
Blake - Ross is going to win this thing in a walk
Ben - You have no doubts? You can tell me
Blake - Oh I keep telling you
Ben - Well then take the bet, I mean you act like your talking big and all but your not backing it up with anything
Blake - Oh it's going to feel so sweet to beat you - okay the bet's on
Ben - So we have a deal
Blake - Deal (goes to walk out) mutters - Ridiculous
Ben - Don't think I won't collect when I win. When this case is over not only will I have you, your going to like it
Blake - You know what I love? I just love a man who's all talk and no action
Ben - Is that why you married Ross?
Blake goes to hit Ben - she leaves
Setting the scene: Blake and Ross are at the suprise wedding for Hart and Dinah. Ben comes up while Blake and Ross are dancing and steps in
Blake: You know, I was hoping I'd seen the last of you
Ben: Oh but the best is yet to come
Blake starts to move away
Ben: Where are you going?
Blake: Away from you

Ben: You'd better congratulate me big brother
Ross: For what?
Ben: Trial of Abigail Bloom
Ross: Well dream on Ben, Abigail has made her decision, I'm her lawyer and it's too late to steal her
Ben: You really think so? Actually I'm not going to defend her - I'm going to prossecute her. I've just been named the new District Attorney for Springfield

Ben: Oh but I am Ross. You better face facts - I'm going to beat you in court again, and again and again and I'm going to dig away at your little life until you have nothing left but regret

Ross: Okay Ben how did you manage to get the District Attorney's job?
Ben: Oh the govonner and I go way back. He was happy to apoint me as your successor
Ross: So you left a lucrative job, a lucrative practice in New York city just to get back at me?
Ben: I told ya, I would do anything it took to ruin you, your career, your family, whatever it takes. Try the potato salad...

Ross: You know Ben you can come after me all you want, it really doesn't matter to me, but don't sacrafice an innocent young woman in the process
Ben: Innocent? I don't think so Ross - Abigail Bloom shot a man in a court room full of witnesses, she'll have to pay for her crime just like you'll have to pay for yours
Ross: I'm glad our mother's not here to see how you turned out
Ben: Your daugther's just about to be married Ross - I think you and your juicy little wife should be getting ready to give her away... I'll say one thing for you, you may be soft but you've got an eye for women - Blake's got a some spark... Is it tough to keep her happy?
Ross: Go to hell
Ben: Oh uh, by the way - did Blake tell you about our bet?
