In Arizona, you can be charged with DUI not merely for driving, but for being in "actual physical control" of a vehicle. We routinely see cases prosecuted where a guy is too drunk to drive home so he sleeps it off in his car. He has the keys in his pocket and he's behind the wheel, so he's in actual physical control. It's a load of crap, but the prosecutors routinely sell it to the jury (who does not always convict in cases such as this). David Euchner
