Defendant to be tried 2nd time in hit-run case

Reem Bishara, the Kuwaiti woman whose hit-and-run trial ended in a hung jury Thursday, will be retried, Maricopa County Attorney Andrew Thomas said Friday.

Bishara, 20, is accused of leaving the scene of the September accident in Mesa that killed Todd DeGain, 35.

According to court testimony, DeGain, who was riding a motorized skateboard, was struck and killed by a car driven by Bishara's friend, Muneerah Al-Tarrah. Bishara ran over the debris of DeGain's skateboard.

Al-Tarrah then struck a pole and drove off into a residential neighborhood with Bishara following. Both were charged with leaving the scene of a fatal accident.

Al-Tarrah fled the country rather than stand trial; Bishara was arrested when authorities feared she, too, might flee.

After a trial that lasted nearly two weeks, the jury on Thursday convicted Bishara of underage drinking and driving but deadlocked on the more serious hit-and-run charge. As they left, the jurors told reporters that they had split 7-1 in favor of conviction.

Thomas said he was certain that a second jury will find Bishara guilty.

"A serious crime has been committed here," he said.

And he said he would seek extradition for Al-Tarrah, who is scheduled to be tried in absentia on April 10.

"They fled the scene and left this young man to die," Thomas said. "We're going to retry the one and pursue extradition for the other."
