Just to start something since Blogland doesn't seem to be active these days (wait a minute is it exam time?). No flames please just nice constructive criticism OK? Of course, before we start, a disclaimer (occupational hazard) that I don't subscribe to women are greater than men nor men are greater than women crap - I believe both sexes have their strengths and weakness and we can learn from each other - enuff introduction, let's get to the meat.

It was an article on the Sunday papers on the changing role of the sexes in society these days. It was entitled "The Men Don't Get It". This is named after a rather well-known slogan used by one credit card line in Singapore aimed at women.

According to the writer, women are getting more influential. As more women are better educated and are exposed to the idea of women excelling in their career as opposed to success being bringing up family in the more traditional and conservative role of a homemaker, men are supposedly losing their purpose in society and are suffering from anxiety by this isolation (men comments?). I'm not exactly sure how the writer justified such a harsh conclusion but the article stated that women were doing well in their careers and enjoying it, so much so they would rather stay single or avoid kids if married. Accordingly, the writer is of the belief that men are increasingly finding themselves reduced to the role of gene carrier. Politely put, the writer (can't remember name and whether man or woman) was pointing out that like the lion, men are only good for a sc*ew and then they're ejected out of the matriach society where the lioness reigns supreme, providing for herself and the kids.

Pretty harsh but thought intriguing. Remember a sci-fi like that being in the primary school library (ok, trust me to find such weird books when I was less than 1.3m in height). But it is amusing. In the animal kingdom, it is the male that preens and courts the female to no end. Female animals are usually drab but HOT commodity to the males who scramble for a mate. For a good part of the human civilisation, it was the female human that did the preening. Corsets to tattoes, starvation exercises called diets to bone lengthening exercises (breaking bone and setting it so it grows back longer - painful and risky), women braved everything and put up with all sorts (not saying men are all abusive but women used to hang onto their man even if he was a wife bashing sicko). Would be rather odd if all that was reversed tho' I'm sure the lioness as well as all female animals have been laughing at the human females for the last thousand years or so.

Then again, maybe it's my brain being weird.

Have I announced how much I love this new workplace. A boss that takes your side instead of the bullying clients (he was actually afraid the client had been rude to me coz he said she's not unkind but hell of the rude - to which I replied, you pay me I put up with almost anything) and bosses who drink with their subordinates.

Where have I been the first 3 years of practice *bashes head on table*

It's not perfect but I'm happy, even if perversely I get more work here. Ok, enuff bumming ... must concentrate on work.

So my plans to leave by noon today are not happening ... anyway, 4pm is the planned exit time - but in the meanwhile, shallow fangurl me has taken to drooling over Malfoy senior's hair over lunch. Woooo ... dye it black, get some glasses and I'm just going to gawk till kingdom come.

Reins was right. I should have glomped that French Clow look-a-like ... gooshhh, he had baby blues but if the eyes were brown and he had an English accent, I would have just DIED.

Mmm, mum's potatoe salad is so yum ... I want to go back and sleep. I've taken to cleaning my room and packing my manga collection and listing the same - gosh, I didn't quite know I was such a mess until I had to pack. Spent 5 hours yesterday clearing one corner of the hall. 2 more corners and a bedroom to go *sweatdrops*

Freak, now I know why Shir's is in love with Paradise Kiss - Good grief ... I want the Jap version for its beauty and the Taiwanese version for the translations - BEAUTIFUL is an understatement.

I think I'm in love with the series ... George the bisexual designer is hilarious. When Yukari asks him if her hairstylist a beautiful guy is his ex-lover, he answers "but I love you" ... Yukari goes green wondering why he had to use the word "but".

HAHAHAHA ... Jap classes tomorrow. Had fun meeting up with friends today tho' we're so worried about R, hearing rumours that our very good friend's bf has major problems with committment and monogamy is not something good. Sometimes I wonder. Is it true humans cannot be monogamous? But isn't the committment in a relationship the special gift one undertakes to one's partner?

COnfusiNg ... and horrifying that at my grand old age ... while peers are worrying about more serious stuff, I'm still the baby kid. Hmmm, better finish work and "giah" home.

In case anyone needs to know, I'm sloshed ... completely sloshed.

Spent the nite drinking and SMSing Reins. Eline, Alv says he's keeping an eye out for the manga you wanted but so far no news.

Eden is out in Chinese. I might get it. And I've got a lo t of manga tonite including Saiyuki Reload and Paradise Kiss - Shir's likes it too and Alv's complaining she buys the series in Jap, and Chinese X2 - HK edition as well as Taiwanese edition coz the Taiwanese translation is better but the HK edition prints the manga better.

Completely sloshed ... goodnite, I've got basketball and piano later today and meeting up with friends too. And I got sloshed last nite with my bosses ... today with my colleagues again, the partners declined on the basis they were too old to get sloshed 2 days back to back.

And I've got Jap this Sunday ... oops ...

Wednesday

Snucked off early yesterday to go to the yacht club with my aunt and uncle ... dinner was pretty good - chicken breast stuffed with cheese yum - by the sea except it took forever for uncle's dessert to come but nothing beats the ice-cream mooncake saga. Yakked nonstop ... I think I talk too much.

I want membership which is a steal at S$8,000 but the place is only accessible by car which I don't have coz I don't drive and coz it COSTS too much to own a car in Singapore and personally I don't subscribe to the idea I should get a guy so I get driven around :P

I think I'll stick to dreaming of owning part of a beach and setting up a cocktail joint there. The response to Friday's department drinking session is shaping up nicely ... a bunch of drunk lawyers *sweatdrop*

Nahhhhiiiiieee ... shoving some work to the weekend, dangerous maneouver but here's the scoop. My sis is so charmed by Eriol she went to order a sheep for herself to put in her work place. I've convinced her to name it Fujitaka (sis works in a Jap firm - giggles) and I'll buy one more myself and name it Clow. It fits doesn't it?

Fujitaka = works at a Jap firm
Eriol = works at a law firm - since we practice common law, the English connection is there if weak
Clow = stays in my house - recluse, Chinese ...

Naiiii ... group trip for friends this year - toss up between Perth and Phuket. Phuket is cheaper and beachy. SIA is having a sale for tickets to Perth - $400 for a round trip and I might get to pop in our friends.

I think I've cracked the receipe for the Royce chocolates. Hee hee ... true chocolates that melt immediately in your mouth to release a smooth chocolate liquor down your throat.

Colleagues wedding dinner was really fun yesterday. Strange how surnames A to K (mine's C involve the most riotous and "mad' people in the office). I so agree with you El. How difficult is it to plonk a mooncake on a plate and serve the damn thing?

Not much manga but the new manga by Ai M is good. Uhm, there's a chobbits narration book but I think it's about 30 dollars *sweatdrop*

GTG, cousins here for dinner. Sorry about twahing you today El, me having diahorrea ths morning so slunked into bed the whole of today to sleep it off.

I so claim I suffer from foetus trauma. When I was due to be born I was premature. Secondly, my dad was arrested by a bunch of CID officers while trying to flag down a cab for my mum. Handcuffed and slamed onto the pavement with a gun to his head. Me as a foetus in mummy's tummy was scarred for life. BTW, aunt yelled at police officers so much they drove us to the hospital where I was delivered about 1 - 2 hours later.

And thus I have problem with rules, problems with authorities, problems with police and a stubborn refusal against wrist watches or bracelets. It's the handcuffs I tell you. That's the story of my life.

Val's selectors are extremely beautiful I couldn't resist. Anyway, I've just cleared my in-tray ... into my bag. My brain is dead having worked with the big boss on a file. The man's brilliant and he probably thinks I'm a floozy ... *shrugs* I need a brain break - never been forced to use brain so much before. But that was one experience ... wow. I wish I was /tat/ smart but obvious am not *double shrugs*. Perversely, one wonders if brain cells got smarter from experience or did they implode from overload (wait a minute, that sounds catchy).

Going to go slow today. Office will be closed for weekend so lugging as much as possible home ... I know, logically I should try to clear today but I'm pooped out. I'm so freaking exhausted even my dad, the advocate of office punctuality is calling me up like 8:45 am when work starts at 9.

Monday

Last nite was fun ... meeting up with old friends and all. Quite distressing and interesting that the attached ones are bringing husbands and boyfriends. Interesting coz you're getting to know more people, distressing coz you really can't help but acknowledge you're no longer a teen *hangs on desperately to delusion she is not old - ugghhh ...* One of the guys my old classmate is seeing is actually a colleague of mine ^_^;; and it feels odd coz both of us know we behave in one way at work and here at my high school gathering, it's a different set of rules altogether (or rather the lack of). Gosh, and internally my Peter-panned self screams, refusing to grow up.

Did research in school this morning, was posing successfully as student asking for help, well even managed to fooble off the fact I was doing research beyond the scope of a usual law student - until lecturer came up and said, "Hi, I thought it was you skulling around, haven't seen you since we both left *insert name of old firm*." Whoops. But then again my firm is a member of the library so technically since I'm there on firm's business, I'm supposed to be able to use the library - I'll just claim I left the membership card in the office or something.

Anyhow, since I was done with research and since my friend didn't feel like doing work, we adjourned to his office and had a long chat in my friend's room. Strange how we are all so grown up now. His door reads "professor so and so" and he's gripping about how unmotivated law students are these days. Bizzare coz how I used to be the one getting it from my tutors about not paying enuff attention to classes. Anyhows like I told my friend, he shouldn't stress himself out, he can teach but students won't absorb unless they want to. Besides, there will always be people who don't pay attention in class but will study on their own, at their own time - in my case, I would only look at my materials for the first time, one month from the exams. Then again, I'm not a prime example of a good student so there :P

The big boss just bumped into me in the lift and asked if I wanted to do a case with him. I'm tempted but I'm afraid I can't handle it.

What to do? Wonder if he'll accept a "I've got quite a bit of work but I'm interested so unless you want to shove off the other files off me."

Sigh ... anyway this gives. I was playing FF VII with my mum again (yes, my mum of nearly 60 plays fff series IV to IX) and we were "to" save the town of North Corel from the runaway train. Perversely I tried to accelerate the train to kill the townsfolk unfortunately I accelerated it so much I broke the engine and saved the town instead.

Quite a fun day.

First met close friends for lunch at pub. Long nice lunch while we all chatted away. Whole pub was crawling with lawyers. Imagine the vibes generated ... but it was good to have everyone together and picking at each other's chips.

Then had some colleagues over for the evening. Mum swears lawyers and their likes are very noisy. I suppose she's amazed how much noise we can generate at my little gatherings every now and then - for one, I guess we laugh louder than most people.

Ate thai food at Thai Express at HV before trooping for magaritas ... yum, had a whole jug. Trooped home and watched GAT while SMSing our other colleagues - LW next time maybe dear? Hope you had a good rest.

Laughed our way through the show. I'm watching it for the 4th time but it's still funny. They left with some of my manga and VCDs so I better keep track. I'm running a library I tell you. Hana Kimi should be well-received.

Work is not getting less but I'm having fun. I've got a little scheme going, I hope it works. UGH, too late to prepare fudge as I promised onii-chan ... ahhh too bad :P and I've forgotten his gal's name - oh no, I'll have to ask discreetly again. I wonder if PX or Johnny will be there tomorrow? If it's PX, I've got an ally against oniichan but if it's Johnny and my cousin-in-law around, I've got more opponents. Hmm, maybe I'll get my onii-chan-in-law on my side *grins*

I like my life better now. I may have troubles still but it's less painful to bear but somewhat deep down, it still hurts. But pain is a sign you're alive I guess. It's late and I'm mumbling.

11 September 2002 - condolences to those who have lost a loved one.

Lesser in the global scale of things but of importance to me - I need to sue a hospital ... I really need to for a certain hospital has written to the home to say that since gran can't be saved they will not admit her. Hmm, yes I see the point they can't wake her from her coma but I don't think it's correct to say that patient should literally be allowed to die no matter what. One I don't believe in euthanasia (forgive the bad spelling but I'm not in the mood to care). Two if any, that decision should be made by the family not some f*wits of a hospital.

Do they think we're stupid? Seriously, solicitors would be hired to handle estate matters not barristars, dummy. Okay ... spent the weekend at home - at home, not in the office *cheers*

No actually I spent it concussted in my bed. It's amazing how I can do things like that to myself *sulks* Needed to go play ball.

Anyhow, now that me am in the office, me can drool over Ko's layout - kawaii - silly netscape on imac at home was making it hard to read since netscape ignores layers. I need to get IE for the imac ... it hangs when css gets to difficult for it - it takes ages for Mura's and El's blogs to load as well as inu-chan's and hangs when I try to read Reins.

Anyhow, Clow's miffed everyone thinks the Korean dudes are cuter than him. Even my sis liked the movie enuff (yeah I bought the VCD) to tell her friends to call her after the show - for a girl who I describe as depending on the phone like an IV drip, that's not common.

Speaking of drips, Gran is off the IV and back to the nursing home. Should see her soon.

So reluctantly am planning to sell some of them. Without being too pissy, due to my neurotic preoccupation with inanimate objects, my second hand manga is in almost top class condition - almost first hand. what is australia's position on variation to contract? does it adopt the cardinal change principle adopted in US and Canadian law - i.e. that it is possible by the order of variations, the party ordering the variations may change the nature of the contract such that the party abiding by the variations may declare that the contract price is invalid and that he is entitled to claim for a new price based on the principle of quantum meruit?

Leareth look at this scottish case of O'Keefe v. Kilcullen [2001] IESC 65 (23rd October, 2001) for an application of Hall v Simons.

Old law -

In the past, barristers were granted immunity from negligence suit with regard to the conduct of trial. This immunity was limited to the conduct of suits and cases have indicated that negligent acts prior to a suit e.g. in the giving of pre-litigation advice are not protected by the rule. The old rule also did not extend to solicitors nor persons engaged for the purpose of litigation - e.g. experts, who could be sued for negligence.

The main points of rationale for the old rule was as such:

1. public interest - a lawyer could not be put in a position where his duty to the court could be compromised (cab rule considered)
2. finality of litigation - no risk of an issue of relitigating the judgment
3. "free expression" in court - no issue of being sued for libel etc.

There were further smaller considerations which could be grouped under the above 3 general categories.

New law?:

The HL in Hall v Simmons stated that they were of the view that the first "rationalisation" is a myth. The immunity given to a barrister cannot be justified as compared to the duty of care owed by other professionals who also have public duties e.g. doctors. He cannot be allowed impunity for his conduct vis a vis the client since there was no real risk to his duty to the court. A barrister could not be negligent if he had acted in a manner because he had perceived that he should have done so under his duty to the court. The HL also stated that the judges could be trusted upon to determine what were genuine complaints by clients and what were instances of unreasonable disgruntle. There was also no injury to public interest as such, and this rationalisation could lend no support to the continuance of the immunity.

The HL was similarly of the view that the 2nd issue was a fallacy as there was no issue of relitigating the earlier judgment ... I suppose in the same way that if a defendant to an action brings a separate action against a 3rd party when he should have brought a third party action, he cannot deem the judgment in his action with the plaintiff to bind the third party. Examples most commonly found in construction law. The developer sues the main contractor for defects in the works. The main contractor chooses to sue the sub-contractor in charge of those works separately ... even if the main contractor is held to be responsible to the developer for defects, he cannot use this judgment to force the judge in the separate action between him and the sub-contractor to come to a judgment that the sub-contractor is automatically responsible to the main contractor for the said defects, i.e. he must still prove his case against the sub-contractor.

With regard to the 3rd point, the HL held that the removal of the barrister's immunity did not change the law on protection against libel etc. as that was separate from the duty of care owed to the client by the barrister.

Submissions:

With all due respect while the HL is correct in legal principles, this case creates a number of practical problems. Statutory intervention may be required to ensure that the decision does not go further than expected.

1. A barrister has no control over the court timelines etc. While the HL indicated that judges would be understanding, the truth of the matter is that you can't comment on the workload of lawyers unless you are a practicising lawyer yourself. There may be an argument that barristers should not take on more work than they can handle but really ... wake up and smell the coffee. The cab rule may be dead as far as legally viewed but in practise can one tell a client you will only accept one case at a time from him?

A solicitor may similarly be over-worked but in a sense, he doesn't have the problem of directions etc. made as his work progresses - a simple case may grow into a nightmare due to the interlocutory applications that mushroom along the hard road to trial.

2. More importantly, what is the test to be applied? Something similar to the Bolam test? Or the Whitaker test? Indications in the HL's judgment point that it is likely to be the Whitaker test. But is this practical? While judges practise law like a lawyer, the 2 are different creatures.

3. Even if one accepts that the Whitaker test is practical, how does one determine if the act was negligent? Lawyer A may decide a point is important and should be higlighted. Lawyer B looking at the same case may think the same point is actually a disadvantage and should be played down. Similarly, is a lawyer negligent if he does not grill the witness like a kerbab? On one hand, one type of lawyers may like to squeeze the answer out of witnesses. On the other, some lawyers believe that trying to gain his co-operation is more important.

Good grief - Mary Sues abound ... El wasn't SF's fic supposed to be an exercise on the ridiculousness of MSs. Are people kidding when they say they are inspired to write more MSs or are they serious?

MSs are only funny when they're not taking themselves seriously or good for one funny laugh but the wonderful beautiful and over-talented token female character from nowhere is BIZZARE!!!

Ugh ... strawberry stain on fav white shirt. The white shirts in M&S in UK are better than the same make of white shirts in Singapore. Scratched and/or dented new phone with law report!!! UGH!!! Only consolation is it's not too large a dent ... Must buy phone cover.

But other than that am happy. Spent last nite haunting harbour. Standing there with the wind in one's face is good. Just came back from shopping with EK. Fun fun fun ... we did lots of silly things but fun fun fun.

Met El for breakfast before sneaking down to NUS to do research. Was caught in traffic jam *sulk* - I'm so horrendously not punctual. Despite horror stories of them checking people to see if they're students, that has never happened to me altho I see some law students looking at me a little quizzedly trying to figure out if I'm one of their classmates who appear one at the beginning of term and disappear until exam times. Then again, I was carrying a lot of law reports.

I've been told I've a lot of evil clones of me running around. Hmmm ...

Have fun in Tioman El. As I SMS-ed her, I've got a movie poster of Guns and Talks. Ugh!!! The show's off so my colleagues can't watch it until I manage to get the DVD from J (when she gets back to Singapore that is). But I'VE GOT THE DARN POSTER!!! Had to cut quite a bit of the border tho - torn too much to bear. You see, they had removed all the Guns and Talks posters except the one near the pop-corn stand (this is one of the most popular cinemas in Singapore in case anyone's interested). Looked around to see if management would change their mind and let me have the poster but didn't even manage to ask as staff was very busy and had no time for me. Sulking coz the movie was off and no one was giving me the time of the day, me went back to poster, panicked majorly for a while when I realised some kids (actually teens) were tempted by the fact I had been drooling over poster and were contemplating taking it. Fortunately for me, they chickened out.

THEN ... spotted cleaner. Decided it was not good to swipe so asked cleaner if I could have it. He said yes!!! *cheers* He tried to help (altho I much rather he had not as he tore the sides quite badly) but he was nice so I couldn't have screamed "stop, you're tearing it" ... As a consolation to myself I tried to rationalise that original poster is wayyyy too big and after trimming off the sides to remove most of tears cleaner made except one that was really quite bad but fortunately not on an face part, it fits my cubicle nicely. Pinned up trimmed poster, called colleagues over and we burst into fangurly squeals that made the male lawyers wonder what we were up to. Conned everyone by claiming I stole the thing and ran and they should watch the evening news for footage of security guards chasing a suited fangurl running with a stolen movie poster.

Hee hee ...

Gran is still sleeping. Met dad onway out of ward. Poor dad-skins is exhausted but trying to make everyone feel better. My dad is the greatest. I'm biased? Well this is my blog *grins and huggles Clow* Gosh ... I so want a Clow-look-alike as a slave ^___^ but anyone who looks like either of the Guns and Talks cast won't be too bad *evil grin*

I don't buy any of it but they're trying to psycho me into turning into a normal person ... NoooooOOOOOoooo ... my folks are cool. My mum just asked "you sure you don't want a slave to boss around?" to which my dad said "ouch!" before we all burst out laughing.

Had lunch with a friend. She's a little depressed but I was of the view the thing she was stressing over was really not her fault nor in her control so just cracked jokes none stop until we both were laughing madly - I'm a bit of an escapist here and not comfortable with dispensing advice. How can one dispense advice unless one is in the situation? She said I was a guy through and through but she missed laughing like that - so I think that should have been alright.

Kinda funny when she asked me what kind of guy I wanted. No prizes for guessing my criteria - grins, why lookie, isn't he bundled up there? But that did trigger a minor panic ... I know this sounds foreign to some of you but at me age when everyone around you is getting hitched and in a society where it is assumed a woman doesn't get a guy only when she's a loser, it's scraping at my self-confidence (but no worries, I've got an ego the size of an iceberg so it'll take some time before this really starts bothering me - I hope).

Personal rants:

Going to see my gran tonite. She's one of toughest birds I've even seen. I hope she wakes and gets well but if she doesn't I know one day I'll still see her again. Without sounding cruel, I rather her happy even if we have to be apart for a while. Looking at her fight, I don't know if she doesn't want to leave us yet or whether there is still unresolved issues that she wants to settle.

Since most of you don't really know my family, with the exception of one or two of you, I'm just going to blare my feelings here - the beauty of a blog is you can yell as much as you want without too much consequence (or so I hope) -

1. The hospital which is so near a MRT station which the home insists on sending her to due to distance is woefully incompetent

2. Where the hell are my uncles and cousins? My mum is getting disgusted and disgrunted by the fact my uncles who are so called more moral beacons, aren't around squat - they had talked so grandly about how when she dies, they'll give her a grand funeral the first time all this happened ... F*? She's still here yo!

I'm not saying everyone has to hover over her bed 24-7 but at least check on her? She had her eyes open yesterday and I don't know if she really could see but she kept holding her left hand out if someone stood in front of her when her eyes were open - especially my dad who gets on best with her. My dad says they do visit but are busy - I think my dad is too kind, he always has been.

My uncles I don't hate but I don't believe them - you see when my gran was a bad tempered person her whole live so I know if they feel queasy about visiting her when alive - as such my dad was like literally her only son for a few years prior to this comma thingee - no one's bitching on this. At the time she first went into a comma, my dad was like totally exhausted taking care of her prior to the comma (he seriously lost weight and he's skinny in the first place so imagine what happens when a skinny thin guy loses weight) and I had already planned a hol months in advance for the family (in between jobs then too) so we did want to go quickly altho we would cut short the hol if anything happened. My uncles said no. My dad was not to go coz he had to attend to the funeral.

(i) Why the preoccupation with her death? Isn't love and care for the person while they're living more important than wailing at the funeral?

(ii) My dad was about to burn out - was a short holiday too much? My gran was extremely difficult before the comma and my dad went up to visit her everyday even my other gran (mum's mum) got worried about his health.

(iii) Where the F* were and are my cousins? Especially the hot-shot engineers in US? An airplane trip costs yes but how many grans do you have?

On the other hand, neighbourly crisis is reaching a peak. Water, bridge and all, haven't we discussed those contracts like 3 times already with them reneging on their contract 3 times? One cannot help but start wondering what makes us think they'll keep to the latest bargain even if we make it through? Please, this is not meant to start a fight especially with those I call friends ... it's just my insignificant brainless voice yakking away.

Hmm, my gran had a heart attack and is in the hospital.

I don't feel too good. I wish my dad told me coz I really could have gone to see her instead of playing with my layout but she's okay for now, subject as usual to the doctor's dismal view of her condition.

I'll see her tomorrow. I hope. Everytime my work piles up and I can't see her, something happens. I'm a jerk.

To the person looking for "Donoghue v Stevenson (law OR legal OR legislation OR regulation)":

Dear, it's an English case on negligence and has become part of the common law of England and many Commonwealth countries. I don't remember it being expressly drawn up as a legislative measure tho altho it is the basis of many negligence principles since. You can get the citation off [1932] Appeal Cases at page 562. If you really need the case, drop me a note.
